Umm, if I recall, never in history did banks automatically opt people the fuck into overdraft protection before there were debit cards. If you wrote a check that you couldn't cover back then, IT BOUNCED. Therefore, if you make a purchase with a debit card that you can't cover, THE TRANSACTION SHOULD BE CANCELLED. Overdraft "protection" is a fucking scam and Bank of America is an unethical company, period. You should be ashamed of yourself for doing business with them.

I went $1.70 over on my checking at BOA and they charged me $54.00 for it. They then charged me $22.00 in excessive use withdrawls from my checking account.

When you say certain things to a collector, the number comes off their list (computer), and the calls stop. When the account gets reassigned to another agency, the number has already been removed.
Don't pay! But don't put up with collection calls, either! My method stops all calls for good! I was a CA manager for years and know the REAL way to STOP ALL CALLS.
Bank of America is CRIMINAL. Besides all the things they do to credit cards, they are the MAIN PERPETRATOR of Foreclosure Fraud, throwing people out of their homes by forging the documents. DEMAND that your bank produce YOUR ORIGINAL mortgage note with your "wet ink" signature (a copy is insufficient, just like a copy of a dollar bill is not a dollar). If the bank cannot produce YOUR original signed note, they can be sued for the mortgage amount +3 times the amt. They've been caught FORGING.
Frankly I'm tired of banks double-dipping on overdraft charges and of conveniently re-arranging the order of deposits and debits to make sure they have a reason for an overdraft charge when there shouldn't be one. I was frustrated with the banker and grabbed my paperwork and got up from the desk. I didn't realize she still had ahold of my debit card which she promptly shredded before I had even left the branch. She said she did it because I left it on the counter, I say she did it out of spite.
It's not just BOA that is doing this. I just had a go-around with 1st Convenience Bank about 3 overdraft charges tacked onto my account. A waterbill that was paid over a month ago had dropped off the pending and disappeared, then it just now reappeared today as pending again. In the meantime I had paid my cell phone bill with what I assumed was the correct available balance. They charged $34.95 while it was still pending, then another $69.80 after it posted. I got them to remove the first $34.95
I received $435 in fees. I didn't even have a checking account nor a debit card! I have new vid explaining my recent experience how bankers get bonuses for tacking on fees. The more fees the tack on the bigger the bonuses.
Bank of America raised my interest rate up to 28%, stabbed me in the back with many of those $30 fees, etc...
SO I CHARED BANK OF AMERICA WITH A $7000 fee...
Yeah, the remaining amount that was due on my credit card. I just don't have the nerve to support a corporation that punishes Americans for trusting their bank in good faith and stealing money from Citizens who worked hard to earn their money. -Do you???

There has to be consumer protections. They have protections for banks when people write hot checks, it's called criminal charges and restitution.
You're right when you say, "It was suppose to be a penalty or a fine." What you may not know is that some of these banks have policies that increase the fines one might get by default. This is what's wrong. When you think you have 10 bucks on you credit card and you try to buy $10.50 in food, the card gets declined. With BOA the card is approved, you get charged $39 for the $0.50 and then your told that they did you a favor and saved your from embarrassment.
Call the bank and ask to cancel overdraft protection...I just did myself!
Call Senator Chris Dodd and show your support for his bill that will stop this shit from happening. He will limit the amount of Overdraft fees to 1 per month, 6 per year. Overdraft fees must be proportionate to the cost of processing an overdraft charge. His number is 202-224-2823. Call and show your support. Google Chris Dodd's overdraft legislation for more information. Pass this message on...post it wherever you can.
I don't fully agree with Chris Dodd's bill. I think people will take advantage of that system. Overdrafts are not intended to interest free, unsecured loans. You SHOULD be penalized for an overdraft. However, I think it is wrong for a bank to run the largest check first, then the smaller checks last.. Then charge you a chain of several overdrafts in a row. Had they ran the smaller checks first, there would have only been one overdraft. Banks are corrupt. But Overdrafts are justifiable charges.
Im suing Citizens Bank in small claims court...980.00 of overdraft fees...
