  • @dryousuck It is their in reality their only choice. Why did East Germans risk their lives to escape into the west? They could try to cross the border legally but many went over the wall in very novel but risky ways.

    To go onto a plane you need a passport, board on a plane through an airport, pay any tax that may be applicable, all controlled by their government - the people they are trying to escape. Do you seriously belive their government would let them go?

  • @dryousuck (cont) Thus Australia was obliged to rescue Tony Bullimore in 1996 and thus Australia has an obligation under UNHCR law to give legal status to any refugee that comes into our territtory. That is why Howard tried to extradite Christmas Island etc. Australia must take the responsibilities and not just the priviledges.

  • @dryousuck Nothing to do with their law or our law but international law and as found in the Franklin River judgement 1983, Australia's International Obligations overide other laws when there is a conflict between the laws.

  • @dryousuck Over 90% of those off the Tampa were found immediately to be legitimate refugees under UNHCR rules. Rules Australia signed and agreed to.
