Nice try you idiot. The NTSB was the agency that released the information that confirmed the engineer was texting 22 seconds before he face-planted the UP. The NTSB report is what led the FRA to institute the emergency order prohibiting electronic equipment while operating a train.

It would be great to see people look more into automatic train stop systems to prevent train accidents in the case of engineer medical emergencies rather than be obsessed with phones and text messaging.
