As far as I know, she is being arrested here. Essentially you're saying anytime a cop talks to someone they have to mirandize them first in case they incriminate themselves? You can be detained, handcuffed (for police safety), questioned and never be read any rights at all. So I'm not sure why she wouldn't be under arrest here.

Something I think is fair under these circumstances because criminals in "normal" situations always have the opportunity to fess up before the police have finished gathering evidence and that always helps during sentencing.
