  • The officer is wrong when says the charge would be resisting. That would only be if he told you that you needed to exit the vehicle because you were under arrest. He made it very clear that he wasn't ordering you out to arrest you. However, you could be charged with failure to obey a lawful order and/or obstruction of justice. Yes, the courts have ruled that officers have wide discretion to order people out of a vehicle during a traffic stop for safety reasons.

  • And he was never heard from again.... Keep us updated. My bet is that if it was a crime and the officers knew it was then you would have been arrested on the spot. My search of "resisting" is only pulling up stuff on resisting arrest. I've never heard of a crime simply called "resisting". After you dug a hole I'm glad you didn't end up getting out of the car. you would have been there for a while as they got you good and cold. A kid I went to school with failed a field sobriety test that way.

  • the police are training constantly. (retired officer) this is not an area they were trained in to my knowledge. dealing with someone who knows the law better than the officer.  officers are ready for someone to resist, but they are not ready for this. secondly: an officer gets used to a person either physically resisting or cooperating. this grey area would be a surprise to most i think. talk is cheap. these cops said the wrong things, but did the right things.

  • You know I can see this from both sides of things. The cops do not seem to be the stereotypical douche's out there. At the same time I agree with what you did. I've never actually had a cop ask me to step out of my vehicle for a ticket...that part is kinda strange to me.

    Now regardless of whether you are legally supposed to step out or not. It's damn cold out there..shoulda asked the cop to borrow his jacket so he could freeze his ass off lol.

  • good job. you handled that with the utmost respect. I'm not sure about the getting out of the car ordeal ut if that does come to bite you in the ass, here is what I do when an officer requests I get out of my vehicle. I pull my keys, set them in my center console lock it then get out of my vehicle and lock the door. However for this to work you need to have a spare key somewhere on the outside of your vehicle. This keeps them from going into your vehicle and looking around without a warrant

  • to the people asking you why push it with a cop over a traffic violation you really cant see how deep we are already into becoming a police state there is no more innocent until proven guilty its the other way around he was speeding that's it they had no reason to ask him to step out of the car and if there an officer of the law they should at least have some basic grasp of it when it falls on you they always pull that ignorance of the law is no excuse stands to reason it should work both ways

  • Oh thats crap. They can't press charges on you for "resisting" since they didn't try to arrest you nor read you your miranda rights. Since they let you go, they are saying that you are not indeed under arrest, why bother serving a warrant, you're right there? If he had a real case you'd be in jail right there, so he was probably just trying to scare you. Aren't you in the Guard though?

    Hooked you for it. You gave your info and signed the ticket, case closed. Good thing you have the video, he can't spin it to make it look you were fidgety or kept doing things with your hands to provide him with the reasonable suspicion necessary to search you or believe there was something illegal in the car.

  • You were detained only for the investigation of the speeding violation. Since you were only being detained, you are not required to do any more than comply with the investigation for speeding. Once you gave up your info, you technically could have been as big as an ass as you wanted and he couldn't do anything. Also, it's actually safer for everyone if you remain in the car. Resisting/obstructing is an arrestable offense. Judging by how annoyed he seemed, if he actually had PC for it, he would

  • What were you pulled over for? Why create an issue with a street cop over something as trivial as a traffic stop? He has no idea if you are armed or a thug with criminal intent. I have always been very open with leo's and never had a problem. I also always have a weapon with me and dont want to get me or my family shot...sooo. Good luck.

  • @silverstackin There was a segment on 20/20 or something like that where certain states only hired people with an IQ of 110 or less. They claimed that anything higher (smart people) meant the person found the job to be repetitious and boring.

    So yeah some states encourage idiots to join. Other states encourage people with degrees that apparently couldn't cut it in their chosen field.....which I guess means they are somewhat stupid.

  • Wow! You have guts! Probable cause is a problem because it is based on the cops opinion of whether it is probable that you are a risk. By disobeying what they consider a simple request, they then may think you are a probable risk and remove you physically?

    Yeah I have begun looking into the UCC stuff a little while ago, but that rabbit hole is deep and I have a lot more research to do before I know exactly what the situation is.

  • Awesome work! I'm lucky to live in a sleepy town where I hardly have any dealings with cops and the ones I have have been really cool. But there is always a time to stand your ground, it's your duty to keep people in line and officers get out of line too.

  • Was this in your home town where you really know the codes? If so, your strategy seems valid, especially if an edc or preps were present. Your sidearm, even legal/with a permit can freak out an officer. Heaven forbid that he see something suspicious. On the other hand, even something like a burnt bulb on your rear license plate could have given him cause to escalate & derailed your strategy. All things considered, driving that hot rod of yours is gonna attract attention. yaknowthat.

  • well i was told to ask them if they are placeing you under arrest if not then they have no reason to make you get out unless they place you under arrest then if they dont get you for anything then you have them for a false arrest and they get to write you a big check

    you are not required to, UNLESS they have actual probable cause to suspect that their safety is at risk if you stay in the vehicle. Of course most times they have no real reason to suspect that.

    But that's why, once he said it was a 'safety issue", I asked what his probable cause was for determining that it was unsafe for me to stay in the vehicle.

    I don't think I will even need the video in court, but even if I do it doesn't matter. Higher courts have held that public servants doing their jobs in public places have no expectation of privacy, and it's not illegal to film them.

  • Wait a minute. Not sure i see the sense in yr little exercise in civil disobedience. You were pulled over for speeding, not due to paramilitary checkpoint. You were the offender and acting pretty suspicious. Willing to bet if you had greeted the officer in a cordial way, you wouldn't have been asked to step out of the car in the first place, the sarge wouldn't have been called from dunkin donuts, and you'd be well on you way w/out calling undue attn to yrself & preps w/ potential legal troubles.

    This was not civil disobedience, as I was not disobeying any laws. If you would prefer to give up your rights to remain silent and be secure in your person simply to be 'cordial' and try to get out of a ticket, go for it. May your chains rest lightly upon you.

  • @boyzco I don't think this was civil disobedience, he was just exercising his right to refuse to do something that was not a legal obligation. A lot of people are easily intimiated by an officer saying you HAVE to do this without even knowing whether that is true or not, which in this case he correct there was no reason to exit the vehicle. This may not have been for nothing because maybe the officers will realize that some people actually know the laws and won't be intimated by them.

  • This is not resistance, this video will eat his lunch! That "warrant" will cause him lose his job. Why send a warrant out, if you did something illegal it is his sworn duty to arrest you then and there. Warrants are for those who cannot be found. Thats like catching a robber red handed and then telling him I'm gonna put out a warrant. Be careful you just pissed him off. "sending officers to your house" is his way of seeing how far you will go to protect your rights. Video that too!

  • Good on you man. Because of some police shootings, cops feel it is necessary to make a person get out of the vehicle. Not a law! That is a deliberate attempt to gain unwarranted access to the vehicle. Two: it is not the cops right to place you in harms way by making you stand or maneuver around your vehicle while adjacent to moving traffic. Yes cops have been shot while going up to cars,but thats their job! Cameras and recording devices work, unless you get searched and they are found and broken

Cops should know not to abuse their powers and claim to have powers they do not actually have in reality - it is the ignorance of people and their blind obedience that makes cops think they can do whatever they want and get away with it. Same applies to politicians and presidents! We should know our rights and object every time a person in a position of power tries to abuse us. They should be scared of us, not the other way around.
