  • James Madison rejected legislation by the general welfare clause, but what did he know? He only wrote the constitution and the bill of rights. I am sure Conyers knows far more than Madison lol.

I guess no one ever explained to him that that section of the PREAMBLE simply explains why the Constitution (which not coincidentally restricts the power of the fed to only the enumerated powers) was written. In essence, he cites a phrase that essentially explains why the document disallowing this action was written as an authorization for the action. He's an idiot. Not only that, he a self-professed socialist idiot.

    Conyers fails to answer a valid question adequately, he does not tell us where to find this clause, + he fails to name any Constitutional scholars.. The way to make money in deathcare is to require premiums & deny care until patient is dead.

    The "general welfare clause," doesn't exist either!!! So, even if he did just "mis-speak" he is still absolutely WRONG!

    The words "general welfare" appearing together in the preamble to Article 1 Section 8 does NOT justify the term "clause" being applied to it.

    "...to pay debts, provide for the common defense, and general welfare...."

    Under Conyers terms, Congress would be able to do ANYTHING to pay debts, pay for the common defense, and general welfare!

    And what about uniformity?

  • @FreeinTX Article 1 Section 8 IS referred to as the General Welfare Clause. i'm not sure why you're arguing that. it doesn't change the meaning and that's not really up for debate. i think other than that we agree in principle.  Conyers' interpretation of the constitution is out of line with the original intent. he is flat out wrong.

The General Welfare clause simply states Congress, in passing laws pursuant to the few enumerated powers listed in Article I Section 8, must pass laws for the general welfare (of the Union) rather than for the particular welfare of any section or group.The Supreme Court and "scholars" are alright with this new law because it fits their ideology, but a logical reading of the Constitution makes it clear that no such law is authorized.

  • Perhaps he did misspeak, but remember that he is chair of the JUDICIARY committee. If any member should know the answer, it's him. But note that he says it's authorized by "other clauses" (doesn't say which), then says that "all the other scholars" he's consulted say it's authorized. He shouldn't have to appeal to other authorities like that. Given his chair, he should be able to handle such a simple question quite easily. The fact that he struggled for a coherent answer is telling.

  • But Hamilton had a more expansive view, and Hamilton's view was adopted by the courts. Of course, even under Hamilton's view, the General Welfare Clause does not support this. It's the Commerce Clause or bust.

    The GW Clause is what allows the fed Gov't to attach strings to funding given to states. It's why the drinking age is 21 in all states. But unless the government gives all individuals money, it clearly can't use the GW Clause to make them enter a contract w/ a private company.
