Here are the facts: Gates followed the officer outside his home and started acting out of control in front of a crowd. I'm Massachusetts, that satisfies every ground for the officer to arrest someone for disorderly conduct. It's the law. Don't like it? Tough.

Everybody who has heard the tape by now knows the officer is a jerk. He (Gates) showed two pieces of ID. Established proof of Identity and proof of residency. He was on the phone with the Home Owners Association when the officer arrived. And I dunno the luggage at the door? "Car 54 where are You?" Yeah the officer could have handled it differently.

1)Well, as I mentioned it depends on what the laws are in that town. Evidently Gates acted out of control enough for them to arrest him. They have laws like this on the books to prevent riots etc. Even though someone may not be physically violent, they can still be out of control. Either way, the cop was coming to protect Gates property. Gates had no reason to cry racism but did anyway. Who knows, he may have seen an opportunity and decided to orchestrate it. It is how he makes his living.

2)There is no doubt Gates will benefit from this careerwise and monetarily. Hes already talking about a related documentary and he'll probably write a book. Are you familiar with the laws of Cambridge and know what constitutes disorderly conduct? If not then you dont know if there was an arrestable offense. The cop was walking into a possibly dangerous situation. For his own personal safety he asked Gates to step outside. Gates refused. He tried to assertain that Gates lived there by asking him for ID. Gates refused. Gates clearly could have cooperated and this wouldnt have happened.

2)IMO Gates got offended that the officer asked him for ID and didnt just take his word for it. Perhaps he is a little self important and figured everyone in the area should know who he is? I dont know. I realize that police abusing power is a problem in this country. I also realize that people are way too quick to cry racism in cases like this. Whether he was lawfully arrested or not is for a court to decide. However, if Gates had cooperated from the start this never would have happened.

He might not have been in the best of moods which is understandable after a long day of travel. The cop had established Gates Indentity listen to the tape. Then went to his car and called for back up from 2 precints. When all those squad cars showed up to arrest a cranky old man who was unarmed and non-violent the line was crossed.Psst off is not the same as violent.
