Right to travel is a federal protected right under 18 U.S.C. 242, 241, ....... The defintion to Suspended license in ecclesiatical law :" you no longer have the benefite to operate in commerce". A suspended license means you no longer have an account with the DMV due to a past due extortion payment. If you do go to jail it will be false arrest, kidnapping, extorition, racketeering. The judge will not move because he has no jurisdiction and will be liable for a suit of damages.

@1Shiznit Not sure how to make it much clearer. Simply put, some one has to file a cause of action, which the cop did not and can not do. Every "crime" has to have a victim. If there is no victim that files a legal cause of action there is no crime/case. If there is no case the court can not hear it. That doesn't mean the prosecutor will not "try it" because it is their job to "try it", but 90% of the time people will not even fight it.

@DjKenada For example, if I come to your house and do damage to your property, you can file a legal cause of action against me for damages. In which case I could be tried in criminal or civil court, depending on the compensation you want. If you want me to pay to fix what I damaged you would take me to civil court. If you wanted me to goto jail you would take me to criminal court. Odds are in that type of case both would apply. How ever it would be the state that would try the criminal

I did not say they can not, because they can do what ever they want if you do not know what they may or may not do. Yes there is a difference. @DjKenada feel the need to pay it because they feel they are no better than anyone else and they are subject to the same rules and laws. Even if that "law" isn't a law at all. If the ones that govern over them say it is true then to them it is true and no further investigation is needed. I could go on but then you will just be listing to a stranger on the Internet. Instead look into court rules and procedures. When you know the rules you can play the game.

@DjKenada If all else fails you can always catch the judge breaking the rules or procedures and file an appeal. This is an easy task, one example is with a conflict of interest. How can one have a fair trial if the officer, prosecutor and the judge are all or at some point in time paid by the same PERSON that is bringing charges against you? Do you know who that PERSON is? I will just tell you, it is THE STATE. I hope this has helped in some way.

She filed a demurrer, it is a pleading in a lawsuit that objects to or challenges a pleading filed by an opposing party. The opposing party being the cop.

Because there was no crime, there was no cause of action. If there is no cause of action there is no case, and a court can only hear cases.

Again like tactikalguy said, "I think where you were at they are honest, because a lot of places will just say denied denied denied."

@wcrompie Another way to beat traffic tickets is to not get them in the first place. I use a product called "Photo Blocker" that basically makes your car invisible to the photo enforced speed and red light traps that are popping up all over the place. Sometimes these things are set up (illegally) to trap innocent people. I also have a dash cam (just in case), but the photo blocker stuff REALLY does work. PS, I don't sell it (maybe I should), I'm just a VERY satisifed customer. LOL

@StevenE1972 You can use the extra protection yes, but when your "Photo Blocker" fails filing a motion to dismiss or in California a Demurrer works 80% of the time unless the judge and prosecutor thinks you don't know what your talking about or are just crooked.

In fact, the local police department here even did a news report wherein they tested it and found that they were unable to successfully photograph the license plates of cars that they tested with the spray on the plates. Not only that, but I have been in a few situations where I was FORCED to go through a photo-enforced intersection after the light truned red because of someone tailgating me. The pictures snapped 7 MONTHS AGO. No ticket...

@DjKenada The only way that the Photo Blocker could "fail" as you say is if I was clocked speeding or something and actually stopped by a REAL police officer. Then again, I go out of my way to avoid breaking any laws or legal codes in the first place. The Photo Blocker is just intended to help avoid being a victim of the red light scams and unpatrolled speed traps. This was clearly setup illegally by the municipality to collect speeding fines on unsuspecting motorists (most of whom will just pay the fine with out question). So, even at that, I could dispute it and have it thrown out. In all such cases (if I actually did end up in court), I would do exactly as you stated and file a motion to dismiss.
