I think it's a wondering thing that there is provision to limit democracy by inalienable rights. @disposablefreedom Actually there were some states that had done something similar but it was largely to prevent their black population from voting shortly after the end of slavery in the US, during a time when they weren't getting the same education as the rest of America's citizens. Such tests were I believe were eventually deemed unconstitutional.

Such tests were I believe were eventually deemed unconstitutional.

Human psychology always portrays 'change' as 'unecessary' and are always 'wary' and 'fearful' of it. Marrying a person from another race was not the 'norm' then. And people in those days were uncomfortable, suspicious and fearful to break that norm. It has nothing to do with religion or ideology. Its psychological and social.

Individual rights should not be put to a vote. Often times democracy becomes two wolves and a sheep deciding what's for supper. This is a Republic with a constitution, not a democracy. Therefore certain rights are guaranteed to others, whether the majority likes it or not. If you look at history, you quickly find out that the so called majority is often stupid, and almost always wrong on any given issue at hand. Why should religious extremists decide human rights issues anyway?

@Fishqueen1972 Using 14th amendment, all people under US jurisdiction (note: not just citizens) have equal protections from being deprived of life, liberty and property except by due process of law. All citizens are assured that no law shall be made to cut their privileges and immunities. How exactly do you interpret this to mean: "States must create an institution that allows 2 men to enter into a relationship with the same legal status as marriage and in fact must redefine marriage that way"

@Mrparrot73 Same sex couples are no different than opposite sex couples. The only difference are the genders. It is an irrevelant difference. They are similiarly situated. And so are the children. Now, the courts have ruled several times that marriage is a fundamental right. If you have a problem with that then take it up with them. No one can vote to prevent prisoners, convicted felons of domestic violence, nor child molesters from getting married.

How come a woman can abort her unborn child but a man cant abort his? Why would you have gender discriminatiom? All your analogies fail b/c there are logical reasons why it is so. None of which apply to the concept of marriage. Gay marriage doesn't change the reality of str8 marriage, nor does it take anything away from anyone else. The principle in gay & str8 marriage are the same. They are both marriages. You can't define what someone else calls their relationship.

@Mrparrot73 You have difficulty with the concept of logical analogies, don't you? Allowing gay couples to marry doesn't take money away from other tax paying citizens. Giving gay couples the right to marry would add to the treasury. If you were to get a gift of $1 billion dollars then you are taking money from others.

@Fishqueen1972 I could demand that the definition of "scientific method" be changed so that astrology could be included as a science. Sorry: "discrimination" occurs when a privilege/right is denied to an individual simply on the basis of color..etc, not when someone thinks his/her tendencies (innate or otherwise) make him uninterested in accessing it. Remember: gays DO have a right to marry, they are just not interested.Voting rights dont discriminate against those who dont want to vote.

Astrology is free to be tested by the scientific method. It is testable. There is no discrimination against astrology. Same sex marriage does not change the principle of what marriage is. Man/woman is just an arbitrary side effect since most people are straight. Marriage really isn't about body parts..lol Grow a brain
