Look at the following verse: "As far as the east is from the west, so far hath he removed our transgressions from us." (Psalms 103:12)

It isn't a fully formed person, at 22 weeks all the vital structures have finished forming, at 24 weeks it becomes viable, after that yes i would say that it is a human.
