I have a false DMCA claim against me, and I filed a counter-claim today, citing "fair use" for the purposes of critique. In the video, I was specific in critiquing the false points, and I even cited the other video and its creator at the beginning of my video. This person is now toying with me about it, and even gave me permission to re-upload after I educated her about fair use, yet she will not retract her claim, because she says "its only a YouTube video." I'm being harrassed. What to do?
Unfortunately, there's not much you can do. YouTube's administration has chosen to setup their policies in such a way that the system allows vindictive psychopaths to abuse the DMCA claims to silence their critics. Really, what YouTube should have is a group of people dedicated to sifting through the numerous bogus copyright claims when it's clear it's Fair-Use, and actually penalize offenders with account shutdowns. As it stands, Amenakin still has her account.
@BareknuckleRoo I'm not sure if YouTube has changed this DMCA claim process, but they e-mailed me after I submitted a counter-notification, stating that if they did not receive a response from the other party in 7-10 days, they would reactivate my video. The other party, through e-mails on YouTube, has made it clear they think I "should not be upset about one YouTube video." We'll see what happens. I propose making a list of members who are aware of "fair use," but use the DMCA for censorship.

The DMCA isn't something that u can choose to follow only when it suits u. It's the law and "fair use" is "FAIR USE". There is no grey area over there.
I'm glad potholer has chosen to take legal action against the abusive practices of YT.
I know someone who filed a dmca against a person who recorded stickam footage without consent and put it on YouTube. However, this person counter claimed with false information so legal action could not be taken against this individual. And YouTube rewarded this person's perjury with reinstating his channel. So if your copyright is violated and the person gives false info, what would be your next option?

im danish. I lived in iceland for 5 years and when i returned to Denmark. I could not get help from the danish state because I was "out off town". i filled a complain. read around 2000 pages of leagal stuff and six months later I were compensated 50.000 kr. around 10.000 dollars. so keep fighting potholer54.
If it was _only_ Potholer maybe he/we could let it slide, but who else has she done this to and how many other times has YT erred on her side, making copyright decisions (& absolving their safe-harbor status) that put into question the legality/guidelines of the DMCA. This isn't just a cause for one person, as Peter said, it's a cause for everyone like him. And there must be legions. Youtube has been playing fast and loose with it's TOS agreement and the legalities of copyright for years now, and have probably gotten away with far worse than this before. Not to mention knowing full well many clips of movies TV series etc. are totally in violation of their given copyright holders rights. Yet, they make good advertising dollars on the channels before the copyrighters find out. Very cheeky!

YouTube can remove any videos they want for any reason. Also, in order to use Amenakin's videos you had to use third part software to download them, technically violating youtube's TOS. It is not illegal for youtube to censor you on their own channel, nor should it be. Websites must be allowed to control the content on their own servers, otherwise, you're forcing them to deliver messages they may not agree with thus violating THEIR first amendment rights. DON'T SUE YOUTUBE.

It appears DMCA has been used against a lot of people on here, not just those who use clips but road safety campaign videos too. Their policy is a bit odd at times. I know of a couple of guys who have sent relevant legal info to Youtube and still had a video removed.
It wouldn't bother me if you shut YouTube down completely. They've grown so LAME over this sort of thing. For that matter, since being bought by Google, they've become pretty lame in every respect, especially in their push of hyper-commercialized content. Yes, they have provided me with a free service and I should be more grateful, but they SUCK, and if you sue them out of existence, c'est la vie.

I have a false DMCA claim against me, and I filed a counter-claim today, citing "fair use" for the purposes of critique. In the video, I was specific in critiquing the false points, and I even cited the other video and its creator at the beginning of my video. This person is now toying with me about it, and even gave me permission to re-upload after I educated her about fair use, yet she will not retract her claim, because she says "its only a YouTube video." I'm being harrassed. What to do?

Unfortunately, there's not much you can do. YouTube's administration has chosen to setup their policies in such a way that the system allows vindictive psychopaths to abuse the DMCA claims to silence their critics. Really, what YouTube should have is a group of people dedicated to sifting through the numerous bogus copyright claims when it's clear it's Fair-Use, and actually penalize offenders with account shutdowns. As it stands, Amenakin still has her account.

@BareknuckleRoo I'm not sure if YouTube has changed this DMCA claim process, but they e-mailed me after I submitted a counter-notification, stating that if they did not receive a response from the other party in 7-10 days, they would reactivate my video. The other party, through e-mails on YouTube, has made it clear they think I "should not be upset about one YouTube video." We'll see what happens. I propose making a list of members who are aware of "fair use," but use the DMCA for censorship.

I know someone who filed a dmca against a person who recorded stickam footage without consent and put it on YouTube. However, this person counter claimed with false information so legal action could not be taken against this individual. And YouTube rewarded this person's perjury with reinstating his channel. So if your copyright is violated and the person gives false info, what would be your next option?

im danish. I lived in iceland for 5 years and when i returned to Denmark. I could not get help from the danish state because I was "out off town". i filled a complain. read around 2000 pages of leagal stuff and six months later I were compensated 50.000 kr. around 10.000 dollars. so keep fighting potholer54.

If it was _only_ Potholer maybe he/we could let it slide, but who else has she done this to and how many other times has YT erred on her side, making copyright decisions (& absolving their safe-harbor status) that put into question the legality/guidelines of the DMCA. This isn't just a cause for one person, as Peter said, it's a cause for everyone like him. And there must be legions. Therefore, it is a "test case" of great importance to present and future YouTubers. Best wishes with the EFF.

Youtube has been playing fast and loose with it's TOS agreement and the legalities of copyright for years now, and have probably gotten away with far worse than this before. Not to mention knowing full well many clips of movies TV series etc. are totally in violation of their given copyright holders rights. Yet, they make good advertising dollars on the channels before the copyrighters find out. Very cheeky!
I bet if your channel was raking in dollars for utube, this would not even be an issue!

More than 400 years of jurisprudence has provided atheism the same protection under the 1st amendment to the U.S. Constitution as any other religion. The fact that you've earned NPO status should be a boon not a nightmare for atheists. :)

I've posted my address for a year and then when I went to work for my current boss living in her house I've consistenly made YouTube users aware of my attorneys address because I believe in being forthright. YouTube can remove any videos they want for any reason. Also, in order to use Amenakin's videos you had to use third part software to download them, technically violating youtube's TOS. It is not illegal for youtube to censor you on their own channel, nor should it be. Websites must be allowed to control the content on their own servers, otherwise, you're forcing them to deliver messages they may not agree with thus violating THEIR first amendment rights. DON'T SUE YOUTUBE.

It appears DMCA has been used against a lot of people on here, not just those who use clips but road safety campaign videos too. Their policy is a bit odd at times. I know of a couple of guys who have sent relevant legal info to Youtube and still had a video removed.

It wouldn't bother me if you shut YouTube down completely. They've grown so LAME over this sort of thing. For that matter, since being bought by Google, they've become pretty lame in every respect, especially in their push of hyper-commercialized content. Yes, they have provided me with a free service and I should be more grateful, but they SUCK, and if you sue them out of existence, c'est la vie.
