At&t gives you about $150 dollars to apply to a new phone, also if you cancel your contract At&t prorates the fee by $5 dollars every month so that at 6 months into a contract you have earned 30 dollars off the contract termination fee, but as an At&t customer I am sure you would not want to cancel your contract. from what i heard NO. I called cingular as well and they say as of like september 2009 all smartphones require the data plan to be used. They said they will even add the plan to your account if you somehow buy the phone without buying the data plan. Now they could just be lying but im not sure.

I instead ended up getting the samsung solstice which is an all touch phone and i love it. Consider it if you dont mind touch phones.
