  • @dahooligan12 Well it isn't fair if they get the death penalty now is it? but, I do think they should put mandatory death penalty for almost every law. Harsher punishment means less crime. And yes, it is proven and does work! Look at the other countries that do this. American Boy got Whiped for throwing an egg at a car. That country never has any crime because the laws are so harsh!

  • @BillMan2002 im not saying they should get the death penalty because some people just end up in a situation where they NEED to drive drunk and it could even be a very short distance. but if its a person who has other methods of transportation or something like that, but they CHOOSE to get behind the wheel, then i couldnt agree with you more, the death penalty would be pretty good.. because theyre putting a lot of other people's lives at stake

  • @dahooligan12 wow! Studies have shown that people who drive when they are tired or texting are just as impaired (if not more) than a drunk driver. Do you suggest the death penalty for someone who texts? I don't condone drunk driving, but your solution would wreak havoc on society ESPECIALLY in the hands of corrupt cops and judges.

  • So basically if you haven't been drinking, just make sure the officer doesn't cover the exit port.

    If you have been drinking, go ahead and take it and claim they covered the exit port!  :P

  • Refuse to take a brethalyzer in NJ and you will automatically be handed a non-appealable SIX MONTH loss of license that runs CONSECUTIVE (i.e. after) to any sentence imposed if you wind up with a drunk driving conviction as well. This guy is an absolute retard. Do NOT take this advice. Instead, try not driving drunk...duh.

  • If you refuse a test in most states, you are automatically charged DUI.

    Also, the breathalyzers shown are the ones for field tests. In most places, this is not the test used for prosecution. If you fail the field breathalyzer, they take you to the station for the actual test, done on a different machine that is required by law to be periodically calibrated.

  • Pretty poor advice from a mail order attorney!!! He wants you to refuse... which in Pa is an automatic one year suspension plus the DUI. Why not take your chances that the officer is a good one and the machine isn't the one demonstrated here. Kinda like saying never stop for a police officer because he may be the one that is the station idiot.

  • "Don't take a breath test" is really poor legal advice. In a lot of jurisdictions, refusing a breathalyser has the same legal ramifications as blowing over the limit. Better to take it and get your lawyer to get the results thrown out in court.

  • Don't confuse the roadside test with one at a police station or hospital once a warrant is obtained. Not the same time!

  • The POLICE (Policy Enforcement) Officers manipulate these as they are basically just corporate revenue collection agents and must meet their quota.

    The whole system has become corrupt and is run for profit in most places.

    They no longer care about acting as Peace Officers anymore to uphold the peace between the people at common law, but put their revenue collection quotas first.

  • NY police say a woman who caused a wrong-way crash that killed eight people on July 26th was severely drunk and had smoked pot not long before the ... HEey go defend her!

  • I don't drink, and I don't like drunk drivers, BUT the more I read about unreliable evidence, the more I think that the true purpose of the law is to make innocent people look guilty.

  • I would never drink & drive as Iknow ever cab driver in town, or could have taken the bus & came back for my motorcycle the next day. no to mention I would not put myself or others in harms way like that it's a small town. thankks any help will be appreciated, this attourney is supposedly the best in town but I whant to win win win no matter what, this will kill my career as a pilot before I even get into school please help.

  • I have a cop friend who swears these things work, & wanting to stay friends i agreed with him. but your right, my attourney is not coming forth with fighting this as much as I would like or that I was denied a chance to ack to goto the hospital. exactly how is the intoxilyzer corruptable> I really need to beat this as I"m not guilty & I hold class A CDL trailer with airbrakes & passenger endorsement.

  • I never claimed to own the air I breath, but neither does the government. If they want physical evidence(as you so deem the air we breath)they can get it from someplace besides my lungs. Did i say anywhere in my post that I was trying to cover up a crime? No. I think driving while intoxicated is a crime. But its a loss of my constitional freedoms to take my breath or my blood. Before you accuse someone of trying to cover up a crime, you need to read what they posted. I dont even drink.

  • Wow, I almost can't believe what I'm reading here.

    No one owns the air! Period! Not the State, The Federal Government, or the individual. However when that airs enters a body, it becomes a part of that body and at that point becomes personal property. It really sounds as if you don't like civil liberties or the US constitution. That's unfortunate because it is the law of the land here in the USA. If you do not like I suggest you relocate.

  • You don't own the air is not mine, that is from the courts. That is why a breath test can be required without a warrant. Still, if someone refuses and the officer or prosecutor really want the blood alcohol level they will just get a warrant and take it as physical evidence of a crime. The point is your blood alcohol level is physical evidence, not giving evidence against yourself as we have a constitutional right not to be forced to do. The courts don't agree version of the constitution.

  • If you had ever seen the havoc and death drunk drivers cause I am sure you would agree. The numbers don't lie. Take any state, more people have died in each state by themselves from drunk drivers then America has suffered fatalities in the Iraq war since it began.

  • Ignore the millions of dollars drunk drivers cost tax payers every year and the thousands of people who have lost love ones in order to try and say its ok to drive while intoxicated. your a fool to take such a stance. Until people starting treating DWI as a serious crime thousands more will die needlessly.

  • I never said I condoned DWI and YES it is a serious issue but that said we can't not disregard civil rights & liberties just for the sake of safety.

    As for the knowledge of this design defect, the Departemtn of Justice has an official Memo they sent to all prosecutors, and all law enforcement agencies detailing the defect and in effect, how to exploit it.

    The memo was recently introduced into evidence in case no. 1215854

  • This is an "Evidential" Breath test used in many areas throughout California. You do NOT have to take a breath test unless you are under 21. You DO have to take a blood test to avoid suspension.
