That's called a sample and in hip-hop a lot of producers use this technique to enhance the instrumental namely Kanye etc. Since the sample is taking from someone else work, you have to get permission from them to use it if you're going to sell your music for a profit. Rick Ross didn't get the OK from the person he sampled from therefore it couldn't be realsed on a CD that would make a profit only mixtape.
