In fact, the _only_ reason he's even still a Justice is because Supreme Court Justices are exempted from the same laws that apply to Judges of the lower Federal Courts, WHICH THOMAS HAS VIOLATED MANY TIMES! This is why there are now BI-PARTISAN attempts at removing this exemption, so that we can either rein him in or throw him out!

Justice Clarence Thomas is a great inspiration and an honorable man. Anyone who tries to discredit him is doing himself a great injustice. Clarence Thomas represents everything good about this nation. He worked his way from the ghetto to the US supreme court. He is the quintessential of the American dream. @thirdshift47 Well, I like the fact that he's a Constitutional originalist. There's nothing in the Constitution allowing for affirmative action. In addition, it's clear that affirmative action violates the equal protection clause. There are countless measures we can take that will no doubt lead to more socioeconomic equality. Whether they are constitutional is a whole other question.

1.)I'm not going to get into Constitutional theory(a whole other debate)other than to say that Originalism is,in my view,problematic on many levels,as well as being often misinterpreted in its own right.

2)Affirmative Action as I understand it is not a violation of equal protection(atleast in theory)simply because it does not mandate,but merely opens the door for institutions to have more freedom in choosing what constitutes real merit.

What makes affirmative action so problemati,though,is precisely the fact that AF-as-quotas are virtually impossible to distinguish as fact.

But if,for example,we were to use Dept.of Labor data(which have white women being the greatest beneficiaries of AF historically)then it would actually indicate that white on black discrimination may have actually increase under the policy.

He should've declined his admittance into Yale then since it got him in. Big misnomer about the policy: it doesn't MANDATE unqualified applicants be admitted. That's ridiculous. What it DOES say is that hey, the history of America has been that white men holding power let white men into positions of power. Not black men, not Asian men, not Hispanic men, not even white WOMEN. Clarence Thomas in my opinion is one of the greatest Supreme Court Justices to take the court. He's a no BS straight shooter and he interprets the constitution as intended by the founding father: STRICT CONSTRUCTION. He doesn't pull decisions out of air because they agree with party lines, but rather what the Constitution has to say about the matter, exactly what his job is.

HAHA. its called the Amendment process. The Constitution, like Justice Scalia said, is a DEAD DOCUMENT. It doesn't have lungs nor a respiratory system. If the people want an addition to the document, they AMEND it with something called the AMENDMENT PROCESS. Do us all a favor and actually read the Brown V. Board case. It was all about strict construction by citing the 14th Amendment. Unlike what you wish to believe, the Supreme Court doesn't make policy, it applies the constitution to cases.
