In addition, it's clear that affirmative action violates the equal protection clause. There are countless measures we can take that will no doubt lead to more socioeconomic equality. It was all about strict construction by citing the 14th Amendment. Unlike what you wish to believe, the Supreme Court doesn't make policy, it applies the constitution to cases.
