I was talking about the right of the states to decide ont he issue. 10th amendment states, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people". The federal government really has very very little power in the constitution and it was done and made so by design. Thomas is one of the most misunderstood individuals in the public sphere. He has been castigated for his conservative views and strict interpretation of the Constitution. The aggravation is that he is THE most principled, fair, and educated Justice in the court. Anyone with some understanding of how the federal government has gained a majority of its power (abuse of Commerce Clause) will know that Thomas was the man saying "STOP!" when everyone else closed their eyes.
His point is that he is being dragged through the coals over matters unrelated (and false) to his ability to be a Justice. Anita Hill's testimony was allowed simply because the legislature feared he was a conservative man that would not allow for the expansion of the federal government and the restraint of "substantive due process."

Anita Hill's testimony in his confirmation hearings was a travesty as well as a deeply personal insult that was supported outright by the prejudice of liberals hostile to his appointment. My statement is that people CAN be pressured into keeping quiet if they are intimidated by those in power. This happens all the time, in many different social structures. If you find that idea to be totally unbelievable, then you probably don't get out much.

His position was based on the 10th amendment which is the right position. It should be up to the states to decide. The supreme court should actually be active in trying to allow freedom and liberty!

I was talking about the right of the states to decide ont he issue. 10th amendment states, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people". The federal government really has very very little power in the constitution and it was done and made so by design. Its a state issue as most things are but the all powerful fed govt sticks its nose in.

Thomas is one of the most misunderstood individuals in the public sphere. He has been castigated for his conservative views and strict interpretation of the Constitution. The aggravation is that he is THE most principled, fair, and educated Justice in the court. Anyone with some understanding of how the federal government has gained a majority of its power (abuse of Commerce Clause) will know that Thomas was the man saying "STOP!" when everyone else closed their eyes.

Anita Hill's testimony in his confirmation hearings was a travesty as well as a deeply personal insult that was supported outright by the prejudice of liberals hostile to his appointment. If there had been any integrity to Ms. Hill's accusations, they would have been made at the time the alleged violations were said to have occurred, not later on and with a vindictiveness defying not only the dignity of the hearings but also of justice itself.

My statement is that people CAN be pressured into keeping quiet if they are intimidated by those in power. This happens all the time, in many different social structures. If you find that idea to be totally unbelievable, then you probably don't get out much.
