Slavery is still legal as punishment for a crime. This loophole is one of the primary reasons why there is a "war on drugs".

The emanciapation proclamation freed slaves behind Confederate lines.
Slaves in the border states were not freed.
They were freed after Lincoln's death.
Kentucky, Maryland--for example-the Federal government paid reparatiosn to the masters when they were freed.

It was partly to encourage a slave revolt and to pacify the real abolitionists in the North.

Well....I know that a break up was tried once...(People here in the south cite States rights ....which I believe was a valid reason )
