@PeeterCZ It should be because the screeches were actually sounds, and not part of the soundtrack which was in the background (if i recall right, the screeches replaced the minigames sounds which would confirm they were sounds and not part of the music)

If you find the others you can write David Whitaker and have him get in touch with the other people covering his music... make the guy some money lol :)

The song in the game plays during a level called "99 Red Balloons" as a reference to Nena's song. I don't think any rights were given to use the melodies in the game.
Whitaker, the game's composer, also took melodies from several other songs. Knowing this makes it funnier that Zombie Nation stole a melody from Whitaker. :-D

Zombie Nation then broke the terms and continued to claim sole ownership of the melody, denying Whittaker's right to royalties, and so on. That lead another case, which opened April 21st, 2010, to re-establish Whittaker as the owner and dish out some pain to the thieves. Google: commodore remix whittaker sued zombie.
@pulseforce Continued: The Google search I refer to at the very end of my previous comment will take you to a forum thread, where David Whittaker and his friend themselves speak about the case. The case was postponed "due to the Iceland volcano eruption" (yeah, I don't see the connection either), and will be resumed tomorrow, September 15th, 2010. I suspect Zombie Nation will be greatly wounded by this and have to cough up a *lot* of money, which serves him right for being an asshole.

@pulseforce But there's a big difference between integrating a couple lines of someone else's melody into your own tune, and just stealing the tune outright and adding a drum machine to the mix.
