  • @TechyBen If you're having problems with false positives on incompetech music, you should get in touch with Kevin McLeod. He's been working very hard with YouTube to get that particular problem sorted, and it only affected a couple of his pieces. Also, the problem wasn't false positives per se, but the lax attitude of claimants who weren't reviewing disputes properly. Incompetech is most definitely legit, and McLeod actually writes music for real movies.

  • i recorded a video at a Xmas party with some background music this was then a copyright violation despite the fact that every club and bar has some sort of sound track running and this audio was of blatantly low quality.

  • @thisisyourwakeup You're not the first person to be caught out like this, and you won't be the last. If you can tell what music is playing, you can't safely post the video. You can try to file a dispute for "fair use", but if the claimant disagrees, you may have to be prepared to take it to court.

  • @berniepot It's perfectly legitimate to mention and link to sites that are relevant. It's posting afilliate links that would be regarded as spam; that, and specifically sending the video to lots of random users or making large numbers of irrelevant comments, stuff like that.

    Even non copyright music gets a copyright claim, even though I have proof that the music used is non copyright & the copyright claimant has not responded to my counter claim as far as YouYellowTube is concerned the copyright belongs to the false claimant.

    It is now 6 weeks since my counter claim.

    I used copyright free "Garageband loops" which some "composer?" has also used & published.

  • @ArGyProductions Check for content ID matches. It may be that the system has come up with a number of false positives: this is a common risk with classical music. Dispute any erroneous content ID matches you find. Some claimants will give you some trouble, and you may need to contact them directly.

Remember the days when we'd borrow our friend's albums, cd's, or VHS tapes and made copies for ourselves? That was the unauthorized duplication they were talking about in the FBI warning. You can legally make a back up copy of your own stuff, You must keep the original and you don't defeat any Digital Rights Management. If it ain't ©, it's copywrong.

  • @BuzziMuzzi That's not how the law works, unfortunately. Maybe the law will change in the future, but it hasn't yet, so we (and YouTube) are stuck with it.

I myself tend to feature videos that are owned by others and whose content have licensed music in them so i try to get permission where i can for everything i do or at the very least give full recognition to people whose content i feature on my channel.   • @PikachuXKurocxhanEX Sure -- it's provided by YouTube and comes pre-licenced. Unfortunately, in many cases the licence agreement means you have to put up with ads on your video, and it's also very inflexible: you have to replace your original soundtrack completely with the AudioSwap track. Personally, I'd use AudioSwap as a last resort, but it is perfectly legal.

At the end of the vid they have cited the sources and they have not been taken down from the site. Like tributes to Amy winehouse etc.... how have they managed to do it?

  • @xdivision100 If you didn't write the music yourself, you can't use it for anything without permission. It doesn't matter where you found it: if it's not your original work, it's not yours.

  • You can't even use CC-licensed music or public domain music. I used the Canadian anthem from wikipedia (public domain) additionally a piece from Jamendo. Result: Muted sounds. No jokes. Take care, where the music is from.

  • @Dschaylizy Everything is under copyright protection unless it specifically says otherwise. The only exception is if the copyright has expired, and currently that's 70 years after the death of the author. It really is that simple: if it doesn't say it's not copyrighted, it IS copyrighted.

It may not be fair (that's a matter of debate), but it IS so simple you really shouldn't have to ask: if you didn't write it, record it, publish it, paint it, photograph it, draw it, video it or otherwise create it, you must get permission from whoever did write, record, publish, paint, photograph, draw, video or create it before you can use it in ANY way at all.

  • @rabidarceus200 That's AudioSwap music, and it is licenced specifically for use in the AudioSwap library -- so it's safe. But you're not allowed to download it and add it to your video yourself: you have to use it within AudioSwap. The disadvantage is that you replace the entire soundtrack with the music.

  • @DeeArrRichard No. Music submitted to Newgrounds is generally done so under a Creative Commons licence. There are different types of Creative Commons licences, so you need to look at the licencing terms of each individual track you use. If you breach those terms, that's copyright infringement.

The book covers are incidental to the video to the extent that their inclusion is pretty much guaranteed not to constitute copyright infringement in any jurisdiction I know of. Legislators may be heavy-handed, even unfair at times, but not completely moronic.

That text has been swimming around the net for years, and is completely useless: it is simply a statement that there is such a thing as "fair use", but simply writing it doesn't prove that your use of third-party material is actually fair -- that's a decision only a court can make.

  • @rewboss Bullshit. Dispute the video, paste the 1976 act in the box and hit send. Within minutes (sometimes seconds) your video will be back up and running with your audio. I've used htis a few times now and never had a problem

  • @BalloonRace Because that's the automated content ID process. YouTube also sends a message to the claimant. Sometimes, they shrug and decide to let it slide. Sometimes they respond by filing a proper DMCA complaint, and that's harder to dispute. You can dispute it, and if you're lucky the vid gets restored after several weeks. If you're unlucky, the claimant obtains a restraining order and you either have to give up or get a lawyer. You never know in advance.

  • @rewboss Because when you copy something you're not taking someone's property, so it cannot be theft. I think the theory that copying destroys the industry for authors, artists etc. doesn't hold up. The internet has only increased those industries.

    Most Disney stories are copies of stories that already existed, and yet they are one of the biggest fighters for copy right.

  • @Ajboi89 All that does is decrease the chances of the automated system finding it. It doesn't make it legal, and it doesn't stop the content owner filing a DMCA complaint against it.

  • actully, this isnt 100% sure, soundcloud is a website who uses creative commons and where small bands can upload videos, so for my latest wow video so i took a song, (witch isnt even up on youtube) only on this website named soundcloud! and the person who made it fixed a download link to download it free, so i used it on my film and bam, it sed i was having third part materials blabla and UMG fucked my youtube account up damn

  • @TheWarlockwarcraft It's possible the person who uploaded it to Soundcloud did so illegally, but that doesn't protect you. Or it was a mistaken or maliciously false claim, in which case you can file a counter claim. But you need to do some research to find out what happened and why.
