no they are not. i've studied international law intensively, and the international criminal court will not prosecute these individuals because they have not commited war crimes. just because innocent civilians were killed during the course of the war does not mean that war crimes were commited. maybe if you studied the enemy tactics you would see that they purposely locate their headquarters in areas with high civilian populations. they are the ones who you should try to get prosecuted.
