Yeah, that's a sticky legal area. Once the threat was over, it's hard to claim self-defense. However, Ohio may have an "imprefect self-defense" exception in their law. The DA has discretion as to if the owner will be charged, or not. If the perp was black, I don't think the DA will charge him. That's just how it is in N.E. Ohio. Minorities don't have much clout.
I'm no lawyer but It seems to be different for every state. If this happened in Los Angeles, the shop owner would most likely be charged and prosecuted. Remember Bernie Goetz in NYC? Big cities take offense to gun violence of any kind. Personally, the Pizza Man is a hero in my book. If you bring a gun into my house or my place of business and threaten me or my family, I hope I have the balls to use any means of self-defense necessary.

I don't believe the color of the perp makes much difference. In Ohio, if you pull an armed robbery and you get shot and killed, tough luck.
Plus, the robber had a mask so it wasn't a race issue for the Pizza Man, it was self defense.
Let's not make everything a race issue and deal with the facts.
