In the remake, it does look strangely like a love scene rather than a rape scene. But ASkars is so much bigger than the previous actor who played Charlie, so I don't think it was necessary for him to hit Kate, so she wouldn't fight him. I think the movie also tried to make this scene ambiguous but in a different way than the original.
