The ones in your cell phone (if they are the RFid) do not have this info so your privacy is kept intact. Thats just according to my understanding.

The difference is that before it becomes legal and they are caught putting personal info on it, they could be charged by law I believe.

Also the fact that a lot of cell phones are sold through third party sellers (like on ebay) makes it difficult for them to know who's personal info to put on which chip. Again, just my understanding.
