The issue arose 6 years before the deposition. Rudy asked the interrogator to give him something that would refresh his recollection. The interrogator was playing the "memory test" game. My guess is there were memos, emails, letters and the like that dealt with these questions and the interrogator was trying to trap Rudy. Rudy is too smart to fall for that trap.

I sat on a jury in a wrongful death civil suit several months ago. That's all the defendants said was "I don't know" and "I can't recall" and "I don't remember". Every single question the plaintiff lawyer asked those were the answers. Yet when the defense lawyer asked questions their memory was crystal clear. Same here with this tool. He knows what he did and he remembers very well. A little waterboarding would help refresh his memory I bet. A lie by omission is still a lie Giuliani.

Lawyers counsel clients before a deposition to never say "no" "that's all there is" or other straightforward answers.

We train them to say "I don't recall." That gives them the ability to later "recall" when it's to one's advantage to recall and it prevents being accused of being a liar.

On some of the shots he's not centred properly. Disappointing camera placement. Also there are creases in the blue background behind him which is distracting.
