Another fink lawyer trying to open up a new source of lawsuit revenue. Anyone who suffered damages for anything can already file a civil suit against whoever damaged them. The federal government is made up of individuals that need very much to be held accountable. Regrettably the average voter pays no attention to what they do between elections and base their vote on a few speeches, their previous bias for one party or the other, and a bunch of campaign ads. War crimes are not subject to Presidential pardon. War crimes are crimes against humanity and transcend national law and national sovereignty. For the rest of their lives, the members of this administration who participated in the decision to torture prisoners of war will be subject to arrest, trial, and execution anywhere on the planet, by any government on the planet.

I think the biggest flaw of this guy's arguments is that it doesn't resolve the crux of the argument. Is waterboarding torture? Right now, its being debated by government officials, and the public.
If this guy had his way, you would just add high priced lawyers to the mix. I suspect that ultimately, it wouldn't really solve anything, but would cost allot more money.
This is the kind of sustained commitment that is needed to truly change govt. There needs to be an army of people who call bullshit on bogus govt rationalizations and work for transparency and accountabilty.
