The attempted garrotting (choking) was based on a true NYC gangster incident, except they switched the characters. Instead of the boss getting choked by the peons, it was a peon getting choked by the boss's guys. And a cop DID walk in right in the middle of it. (See Gallo-Profaci war, 1961).
The film was really hard to understand for me the first time around. Michael told Hyman Roth about the hit and then waited to see whether it would be carried out. Taking out Pantangelli because Roth figured Michael was going to anyway. Had they done it alone, the Rizotto Brothers wouldn't know it was by order of Michael. By interfering in Michael's affairs he failed the test.
It was actually more of an honor thing. Even to this day the Sicilian mafia has upkept the code of silence to a much higher degree than its American counterpart. His brother was just there to tell him to take his pinch like a man.
