Therefore they are bound tightly by the constitution, amendment 4 of which says they can't randomly search people without reasonable suspicion. What they are doing is the same as if they put road blocks up and stopped random cars to search.. illegal.
@vibratingstring even if TSA were a private company, the water would be murky. You can't legally sign a contract that requires you to hand in your rights. So, any agreement entered into upon purchase of a ticket that states you have no 4th amendment right when traveling would be legally null and void. They could still turn you away, but would have NO right to search you. As it stands, they insist that if you leave the security area without being searched, you can be sued, which is not legal.

A private company could have a stipulation that says "You must allow us to grope your privates or see you naked or you can't fly on our airplane", but they would have no legal right to actually grope you. They could uphold their contract and refuse to let you fly if you don't comply, but they would have no actual legal entitlement to violate your 4th amdmt right.

Actually, it isn't even disobedience. A pat-down is one of two screening methods offered. If you get pat-down instead of scan, that is not disobedient. You are following the rules. Disobedience would entail not accepting either, or say lying down in the scanner lanes or something. Of course then the TSA would haul you away, literally, and try you for a federal felony. If you lie down in front of Macy's, it isn't a federal felony...that's the problem...the airlines are Private Business

Because I believe these under-trained, under paid, agents are bullies in TSA clothing. They will probably focus on people they feel they can intimidate and let (as has been proven) people who are a real threat skip right through the line. I GOT BOTH And guess what? The View is very hypocritical. They had a very negative view about the pat downs one episode. Sherri almost went insane after they showed a video of a little girl being molested. After the Obama interview everyone changes their mind. Sherri actually says she will tell her child it's a game and they are searching for somethign on him. These people are being FED what to say. The constitutionality issue and whether I (or you) fly are two different issues. My decision whether or not to fly is mine alone. Every American's right to interstate travel by air, land, and sea is protected and has been upheld by the courts for decades.
I will not tell you not to fly because you, like me, definitely has the right to do so and I wouldn't be so arrogant as to say otherwise.

Therefore they are bound tightly by the constitution, amendment 4 of which says they can't randomly search people without reasonable suspicion. What they are doing is the same as if they put road blocks up and stopped random cars to search.. illegal.

@vibratingstring even if TSA were a private company, the water would be murky. You can't legally sign a contract that requires you to hand in your rights. So, any agreement entered into upon purchase of a ticket that states you have no 4th amendment right when traveling would be legally null and void. They could still turn you away, but would have NO right to search you. As it stands, they insist that if you leave the security area without being searched, you can be sued, which is not legal.

@vibratingstring to clarify, it is COMPLETELY illegal for TSA to randomly search private citizens (whether by scanner or groping). A private company could have a stipulation that says "You must allow us to grope your privates or see you naked or you can't fly on our airplane", but they would have no legal right to actually grope you. They could uphold their contract and refuse to let you fly if you don't comply, but they would have no actual legal entitlement to violate your 4th amdmt right.

Heck, a jury would probably find the searches meet the constitutional guidelines of "reasonable" insofar as we've had a number of close calls with bomb attempts this year.

No, it is not at all the same as random road blocks. In that case, they approach you. In this case, you approach them, and it applies only to boarding airplanes. You can walk away. You can walk right up to the checkpoint, and walk away. It is not at all equivalent to the roadblock search, or the man on the street search. In those cases, they must have probable cause, or a warrant. If they create probable cause (often done--it is called DWB) it can an should be thrown out of court...

Actually, it isn't even disobedience. A pat-down is one of two screening methods offered. If you get pat-down instead of scan, that is not disobedient. You are following the rules. Disobedience would entail not accepting either, or say lying down in the scanner lanes or something. Of course then the TSA would haul you away, literally, and try you for a federal felony. If you lie down in front of Macy's, it isn't a federal felony...that's the problem...the airlines are Private Business

And not all civil disobedience is unlawful; Remember the bus boycott by black people during the civil rights era was just a boycott. So the same is true with the TSA situation today... by boycotting the scanners and opting for the pat-down we are sending a message and impacting the TSA because WE'RE PISSED OFF.

In September 2006, O'Donnell replaced Meredith Vieira. This is when I started to have trouble watching The View. At that time, The View didn't have 100% Political views. The show concentrated on women's point of view of everyday life with an occasional national topic. In 2007 The View went "Political" and "Special Interests" - that's special interests of the hosts. I started avoiding The View at this time.
