once the officer pulled the guy over for going 20mph over, all he had to do was arrest him. At that point, the guy can no longer deny the officer searching his vehicle. The dog was not necessary this time, as speeding 20mph is a jailable offense as the officer stated. He would not have had it that easy.

I can not tell you how many warnings I've been given instead of tickets, by simply smiling, saying Yes Officer. never give consent to search. I was told once by an officer, after arresting my passenger for a warrant "alright mister Darby, If we could just search your vehicle real fast we can get you on your way." my response? "Nah, I'd rather you didn't." "you'd rather we didn't?" "Yes Sir." "umm...ok...hang on a second." "No problem."-5mins later he came back gave me my info back and let me go.

Anyone has the right to say no to a search without a warrant and most officers will simply let it go. He did not have to lock his car. If he would have said no when the officer asked to search the car, that would have been end of story.
@cole1500 I was pulled over by a cop for rolling through a stop sign once and that guy gave me the 3rd degree. Tons of questions about where I was heading, who I was going to see etc... He was fishing for an excuse to search the car.I wasn't searched but I was given a ticket. It really pissed me off. Yeah, I was guilty of rolling through the stop sign but it was none of his business as to where I was going. Next time (if there is one) I will refuse to answer questions in a respectful way.

He would always leave when I refused a search, I would just say "I really don't have time for that" or equivalent.
The point of this video is not to act as an indictment of the police (they perform a tough and vital service), it is to inform the citizenry of how to exercise their rights. We have a 4th and 5th amendments (USA) for a reason. They are there to protect the innocent.
As a young man I was frequently pulled over and occasionally harassed. I had my POS car searched 5 or 6 times. I wasn't a punk or into anything heavy; but I was a kid and kids get in trouble. I never got busted for anything; but neither did I understand my rights to not be harassed. This is not a police state. Sometimes the police forget that and get an "Us v. Them" attitude. They need to be gently reminded. Admittedly my experiences are more pleasant now that I'm older.
I'm stunned by those who seem more than a little offended that anyone would demand their rights. In my eyes it is clearly in your own best interest. A right not exercised is a right abdicated. In a situation like this, you are likely beyond the point of a warning, and the officer is actively looking for something greater to bust you on. Whether you are guilty of something or as lily white as the driven snow, it is YOUR responsibility to demand your rights.

What is stopping the cop from calling a police dog? They don't need an official reason for that and it's possible that the cruiser was already a K9 unit. The dog could easily sniff out a reason to search.

Now, if they saw an open bottle or saw a bag of weed, that gives them authority to search. A police dog alerting them is not probable cause. Don't consent to searches. Loved this. I RARELY have anything in my truck. The times that I do, it is a few airsoft guns in the bed of my truck or in the cabin. But still knowing this makes me feel a lot more confident to deal with a police officer

@bart40330 it could help getting out of the ticket... Cop pulled me over for speeding, but he became more concerned about drugs and lack of insurance. I let him search my car, he found no drugs, but he did find my insurance card. By the time it was said and done he forgot why he pulled me over in the first place and let me go.
I acknowledge that I had given up my right, but not pissing off the cop and lessening my chance for a ticket was worth it.
Here's the proper way to handle the ticket. Tell the officer I am a human being. I recognize that as a bill of exchange. I want the original. The cop then rips up the ticket.

They showed two scenarios, one where the driver waives his rights and the cop ends up searching the car and bags and ends up finding drugs and they are arrested . Then there is this scenario where he enforces his rights and he only gets a speeding ticket. Without watching the other scenario you can't tell he has drugs but he did have some in his bag.

@MorehouseTunes Yes. A dog hitting on the car is probable cause. However, K-9 units don't just fall out of the sky upon demand. If the officer says "I want you to wait here for a K-9 unit," and you do without objecting, in court the cop and judge will say that you waited on your own. Instead say "No, I have somewhere to go and I want to leave. Am I free to leave?" At this point the cop must either let you go or detain you. If he says you are being detained, then you have a right to know why.

2) The speeding charge is indeed a valid probable cause reason to detain and/or arrest him; this entire video is the account of the driver and passengers being detained for the driver speeding. Pennsylvania v Mimms, Maryland v Wilson, & Brendlin v California -- once stopped, the driver and all passengers are being seized.

@FoxeoGames Your examples are terribly flawed. In Wilson, a large bag of cocaine fell to the ground. In Mimms, the driver was carrying a noticeable concealed deadly weapon. Brendlin actually strengthened the passengers' right to privacy. As for Largo, there's no question that he could be arrested for speeding, but for what purpose? This no longer gives the officer the automatic right to search the car, and a passenger would just drive down to the station and post his bail.
@bart40330 The reason Maryland v Wilson is relevant is what is upheld by the court. The argument wasn't over the cocaine; that is NOT in question. The argument was over whether the stop, as effected, was legal. Wilson argued that the officer ordering him (a passenger) out of the car was an unreasonable seizure of his person.
The court ruled that it was not unreasonable, and thus, officers have the right to order passengers to remain in the car or to exit the car. See the conclusion.

@bart40330 The "officer" in this pretend scenario, if it were real, would have more than reasonable suspicion -- he would have probable cause. He says he clocked them going 50MPH, which we assume is by RADAR/LIDAR or pacing. In this scenario, the speed limit I believe is supposed to be 30, so he's doing 20 over -- a crime. This can be handled as either a traffic ordinance charge (local charge with a fine), or via the state misdemeanor charge (on an arrest & transport).
1) 50 in a 30. 2) Four inch gap in the window when addressing the officer. 3) Closing all windows and locking the doors when instructed to leave the car. 4) That's when the officer calls for back up regardless of the charge. Constitution or not, your at their mercy. Valor is the better part of discretion at this point. I assure you it's not a ten minute affair.

once the officer pulled the guy over for going 20mph over, all he had to do was arrest him. At that point, the guy can no longer deny the officer searching his vehicle. The dog was not necessary this time, as speeding 20mph is a jailable offense as the officer stated. He would not have had it that easy.

I can not tell you how many warnings I've been given instead of tickets, by simply smiling, saying Yes Officer. never give consent to search. I was told once by an officer, after arresting my passenger for a warrant "alright mister Darby, If we could just search your vehicle real fast we can get you on your way." my response? Anyone has the right to say no to a search without a warrant and most officers will simply let it go. He did not have to lock his car. He was fishing for an excuse to search the car.I wasn't searched but I was given a ticket. It really pissed me off. Yeah, I was guilty of rolling through the stop sign but it was none of his business as to where I was going. Next time (if there is one) I will refuse to answer questions in a respectful way.

As a young man I was frequently pulled over and occasionally harassed. I had my POS car searched 5 or 6 times. I wasn't a punk or into anything heavy; but I was a kid and kids get in trouble. I never got busted for anything; but neither did I understand my rights to not be harassed. This is not a police state. Sometimes the police forget that and get an "Us v. Them" attitude. They need to be gently reminded. Admittedly my experiences are more pleasant now that I'm older.

I'm stunned by those who seem more than a little offended that anyone would demand their rights. In my eyes it is clearly in your own best interest. A right not exercised is a right abdicated. In a situation like this, you are likely beyond the point of a warning, and the officer is actively looking for something greater to bust you on. Whether you are guilty of something or as lily white as the driven snow, it is YOUR responsibility to demand your rights.

I remember this trick an officer tried to do to someone, if you admit to a cop that yea you attacked that guy first, he will talk to you more. He might ask you a question "Did you do it to commit serious bodily injury upon the person of another" he may keep repeating the question. if you say to the cop "but he scratched my car" cop: did you see him do it? u say no.
If you didnt see that guy do it, cop cant help you. and you trying to justify why u attacked him will be used to help incriminate u.

Everyone dissing this video needs to read up on the Constitution. I exercise my rights to refuse search and not tell them a word every time I get pulled over. I do not do drugs. I drink rarely, and never drive under the influence. It pisses off the cops, but I am protected under the law to not allow them to try to get me to admit anything and not to allow a search. What is stopping the cop from calling a police dog? They don't need an official reason for that and it's possible that the cruiser was already a K9 unit. The dog could easily sniff out a reason to search.

FYI: -Legally, Police cannot search a vehicle without 'Driver-consent', unless they've a Judge-signed/dated 'Search-warrant' per 4th-Amendment of usConstitution, guaranteeing us protection against 'Unreasonable Search & Seizure'. I let him search my car, he found no drugs, but he did find my insurance card. By the time it was said and done he forgot why he pulled me over in the first place and let me go.
I acknowledge that I had given up my right, but not pissing off the cop and lessening my chance for a ticket was worth it.

@bart40330 This is copied from another channel called flexyourrights. They showed two scenarios, one where the driver waives his rights and the cop ends up searching the car and bags and ends up finding drugs and they are arrested . Then there is this scenario where he enforces his rights and he only gets a speeding ticket. Without watching the other scenario you can't tell he has drugs but he did have some in his bag.

okay so what if the cop does show up with a dog tho? if the dog is sniffing out your car and even tho it's locked he "smells something" can they get you?

@MorehouseTunes Yes. A dog hitting on the car is probable cause. However, K-9 units don't just fall out of the sky upon demand. If the officer says "I want you to wait here for a K-9 unit," and you do without objecting, in court the cop and judge will say that you waited on your own. Instead say "No, I have somewhere to go and I want to leave. Am I free to leave?" At this point the cop must either let you go or detain you. If he says you are being detained, then you have a right to know why.

Any attorney right out of law school would shred that to bits, but it is up to you to demand that you be allowed to leave. 1) Probable cause is not necessary to detain them; reasonable suspicion is.
2) The speeding charge is indeed a valid probable cause reason to detain and/or arrest him; this entire video is the account of the driver and passengers being detained for the driver speeding. Pennsylvania v Mimms, Maryland v Wilson, & Brendlin v California -- once stopped, the driver and all passengers are being seized.
He can be arrested on traffic charges: Atwater v City of Lago Vista

@FoxeoGames Your examples are terribly flawed. In Wilson, a large bag of cocaine fell to the ground. In Mimms, the driver was carrying a noticeable concealed deadly weapon. Brendlin actually strengthened the passengers' right to privacy. As for Largo, there's no question that he could be arrested for speeding, but for what purpose? This no longer gives the officer the automatic right to search the car, and a passenger would just drive down to the station and post his bail.

@bart40330 The reason Maryland v Wilson is relevant is what is upheld by the court. The argument wasn't over the cocaine; that is NOT in question. The argument was over whether the stop, as effected, was legal. Wilson argued that the officer ordering him (a passenger) out of the car was an unreasonable seizure of his person.
The court ruled that it was not unreasonable, and thus, officers have the right to order passengers to remain in the car or to exit the car. See the conclusion.

@bart40330 The "officer" in this pretend scenario, if it were real, would have more than reasonable suspicion -- he would have probable cause. He says he clocked them going 50MPH, which we assume is by RADAR/LIDAR or pacing. In this scenario, the speed limit I believe is supposed to be 30, so he's doing 20 over -- a crime. This can be handled as either a traffic ordinance charge (local charge with a fine), or via the state misdemeanor charge (on an arrest & transport).

1) 50 in a 30. 2) Four inch gap in the window when addressing the officer. 3) Closing all windows and locking the doors when instructed to leave the car. 4) That's when the officer calls for back up regardless of the charge. Constitution or not, your at their mercy. Valor is the better part of discretion at this point. I assure you it's not a ten minute affair.

@bart40330 It is highly suspicious, and will the make the cop very very concerned about his own safety. Behaving like this in a real stop will definitely end you up on the curb in cuffs, regardless of the actual reason for the stop.
There is no reason for acting like this! You don't need to piss of the cop. Be polite, do everything he says without big discussion and apologize for any fault, but of course don't consent to searches.
There's a good chance to get away with a warning

Justification for ending in cuffs? Simply, you are acting like you are hiding something from the police, you all are pretty nervous and don't comply on orders, the officers is outnumbered 3 times.
In reality he would most likely detain you and cuff you, for his own safety. He might even pad you down.

The driver is indeed a smart man, and not a "smart ass little punk". Although locking your doors LOOKS a little sketchy, no crime has been committed. No probable cause = no search.
I wonder if this would work in Canada?
