Sampling has been a part of hip hop related music since it began in the 80's and there have been some amazing sampled instrumentals over the years. Brain Police receive royalties for this anyway, so their winning off the success of the song anyway, if that makes you happier.

You can't really claim that he isn't an artist considering that he writes and produces most of his older songs. Also, artists like Adele and even Ozzy Osbourne don't write or produce their own instrumentals, so he normally does more than them to be fair, even if it isn't a genre you necessarily like. This is a 'going mainstream' song.
