That theme is first played when you finish the game with Yugo and you fight his brother Akira in Normal Mode before you challenge Kiya.

In addition, the same background is used when you use Jelly and fight Billy. The only difference is the music is set to a punk - punk/rock theme when they are fightning each other in VS Mode, or you first fight Jelly in Normal Mode.

@crepe626 Yeah pretty much that's what I meant to say. It is Akira's stage music. But like I said, the music is different when you fight Jelly / Billy in VS or Normal Mode, despite the background being the same.
