@fugdkn If you use it constructively (comment, review, remixing, taking a clip from the song, etc.) then you can use any copyrighted material on your videos under "Fair Use." If you re-upload the song outright, with no original content of your own, that is illegal and violates Youtube's Terms of Service contract (the thing you clicked "agree" on when you signed up for an account).

@fugdkn If you use the song in a CoD montage that doesn't really fit under fair use. It would probably be taken down/strike. Your use of the song in that case isn't really adding commentary, criticism or improvement of the original work (the song).

@TheDubJake That's not necessarily true. A clip can't be longer than a certain amount of seconds (which I forget) and I've seen many a remix taken down. You can't use another's work without their permission. Most artists won't attack you if you remix their song without permission, mostly because it inspires curiosity about the original work, but I've definitely seen it happen.

@xKryDJx You can use as much copyrighted material as long as you are actually commenting, criticising or expanding on it. Plain copying is limited to 6 seconds or so.

But yes, take downs happen in a lot of cases where the use of the song is actually legal, too. There are many abusers of the system and so copyright holders are trigger happy to take videos down because they see it as an infringement of their property (and profits).
