This is how tight the security was in there...and I know because I was there: we couldn't leave gregory gym until the president got in his motorcade and was on the road. @omtara Police officers have a duty to uphold the Constitution, it's the supreme law of the land. When police officers violate people's constitutional rights, they are violating the supreme law of the land. Therefore they have a duty to refuse the order. It's the same in the corporate world, if your boss orders you to commit fraud, you have no duty to carry out the fraud, instead you should refuse and if it results in your firing, then you sue the company.

@steve77008 Yes he is protesting the wars.. If you had watched the video you would have been able to deduce this for yourself. We have the right to assemble and peacefully protest. Even the rules for the UT campus are fairly clear on this matter, including where it can take place.
The justice system is supposed to protect us, not arrest people for exercising their rights. I've met Dan a couple of times, and he is no criminal and always has the best of intentions. Deal with it.

However, if you have read the comments in this thread you would notice that several comments on here have been unclear whether the poster was supporting Dan in regards to free speech or his opposition to the war.
@Magetalion2000 - As far our rights to assemble & peacefully protest, I believe that has been adressed already. Dan's rights were not violated. However if feels they were, he is free to hire an attorney and sue the University of Texas, their policed department, the Secret Service, the president, or whoever he wants to. The rules of the UT campus are not the issue here. Federal law & case law allow the Secret Service to take the actions they did. But feel free to file a lawsuit.

See the problem with segregating protesters to certain areas is that then you must have different areas for different protesters. Or would UT Austin have liberal protesters and conservative protesters all confined to the same area? That would turn peaceful protests into chaos and anarchy and it would guarantee violence. But if they designate different protest areas for every different type of protesters, how would they ensure they be separate-but-equal? Obviously they cannot.

He kept telling the police officer there weren't any anti-war protesters there, but the police officer just kept telling him to go protest in that area. @DOHC2L I'm against the war, but it's pretty hard to fight from jail. That cop happens to be someone I've known for a long time and he has worked hard to be with the APD. Any job, you will find this out someday, has someone on top handing down orders...the CIA in this case. If you can't follow those rules, you won't keep that job Trust me, if you ever have a job, especially one you love, you will learn.
@Aloanstar I had that job. I had to walk away from the job because of bad management. But the point is not conceded, police officers are sworn to uphold the constitution. If they have an order from a commanding officer to violate people's civil rights, those police officers have the duty to not obey such orders. This is why we have them swear an oath to the constitution, because corruption of the law by law enforcers is always a possibility they and we should be aware of.
@DOHC2L Maybe you did, but not all police officers are corrupt and this isn't about violating civil rights. I would agree if it were not for the fact that Obama was there and the most important thing was protecting him. There are reasons why protesters are not always allowed to go anywhere they want. Zones are sometimes designated to protect people, abortion clinics are a good example. I think Dan wanted a more a sensational confrontation, but it wasn't exactly Kent State. He needs to grow up.

@DOHC2L - I'm not the one allowing government officials to do anything. The Supreme Court has ruled that reasonable limitations can be placed upon our rights. Allowing the Secret Service to control movement near the president (in order to protect him) is reasonable. If you disagree, get a lawyer and sue instead of behaving like a child and getting yourself arrested (not directed at you DOHC2L in particular).

Fred Phelps little family cult are the one's that protest at soldier's funerals, best know for protesting at Matthew Shepard's funeral and they are not allowed to come anywhere near the gravesite. His group has been arrested numerous times for pushing the limits. People at the funeral usually stand so the protesters can not be seen by the family menbers. Phelps is crazy and he is not a good example to follow.

They did give the dude the chance to move without being arrested. It's not like he was walking by and they just ran up on him and arrested him. They tried to be civil and explain it to him. Do I think that they should have to right to tell you where you can walk with a sign? No. Do I think you should move if a cop tells you to move? Yes.

However I still believe the person being recorded was looking for a confrontation (instead simply moving across the street) and it still appears that the person doing the recording was supportive of this.
To the people saying the Secret Service "has the right" to do this, keep in mind that the gym where he was speaking was a football field away, that the president was in said gym for hours at this point, that Dan was not trying to force his way in, and that Dan did not make any violent move at any point.
Obama is without a doubt a socialist & a statist, but he is still the president and the Secret Service has the legal authority to shut down areas around the president & control access to him. If they had closed the area off for the safety of the president and he was crossing a barrier, then sure go ahead and arrest him. @kuhlraum Keeping the walkway open does not necessarily involve keeping all people off of it at all times, but to keep people moving. Such that everyone can be cleared as the President comes through. This is how tight the security was in there...and I know because I was there: we couldn't leave gregory gym until the president got in his motorcade and was on the road. This cop was just doing what he was asked in order to protect the president, students at UT, and citizens of this city. He gave the protestor several chances to correct his behavior (continued..)

Dan wasn't arrested for "just trying to walk on the sidewalk" The officer asked him several times to move the area that was sectioned off for protesters. When any POTUS is in the area, I'm glad they don't let just anyone hang out anywhere they want. When you are told you will be arrested ahead of time, it's your choice. Dan chose to get arrested. I've been to DC many, many times for protests and seen tons of people get arrested, but before they were, they knew it was going to happen.

When police officers violate people's constitutional rights, they are violating the supreme law of the land. Therefore they have a duty to refuse the order. It's the same in the corporate world, if your boss orders you to commit fraud, you have no duty to carry out the fraud, instead you should refuse and if it results in your firing, then you sue the company.

@steve77008 Yes he is protesting the wars.. If you had watched the video you would have been able to deduce this for yourself. We have the right to assemble and peacefully protest. Even the rules for the UT campus are fairly clear on this matter, including where it can take place.
The justice system is supposed to protect us, not arrest people for exercising their rights. I've met Dan a couple of times, and he is no criminal and always has the best of intentions. Deal with it.

However if feels they were, he is free to hire an attorney and sue the University of Texas, their policed department, the Secret Service, the president, or whoever he wants to. The rules of the UT campus are not the issue here. Federal law & case law allow the Secret Service to take the actions they did. But feel free to file a lawsuit.

See the problem with segregating protesters to certain areas is that then you must have different areas for different protesters. Or would UT Austin have liberal protesters and conservative protesters all confined to the same area? That would turn peaceful protests into chaos and anarchy and it would guarantee violence. But if they designate different protest areas for every different type of protesters, how would they ensure they be separate-but-equal? Obviously they cannot.

@Aloanstar I had that job. I had to walk away from the job because of bad management. But the point is not conceded, police officers are sworn to uphold the constitution. If they have an order from a commanding officer to violate people's civil rights, those police officers have the duty to not obey such orders. This is why we have them swear an oath to the constitution, because corruption of the law by law enforcers is always a possibility they and we should be aware of.

I would agree if it were not for the fact that Obama was there and the most important thing was protecting him. There are reasons why protesters are not always allowed to go anywhere they want. Zones are sometimes designated to protect people, abortion clinics are a good example. I think Dan wanted a more a sensational confrontation, but it wasn't exactly Kent State. He needs to grow up.

@DOHC2L - I'm not the one allowing government officials to do anything. The Supreme Court has ruled that reasonable limitations can be placed upon our rights. Allowing the Secret Service to control movement near the president (in order to protect him) is reasonable. If you disagree, get a lawyer and sue instead of behaving like a child and getting yourself arrested (not directed at you DOHC2L in particular).

You have the right to say what you want (again with reasobable restrictions) but you are NOT guaranteed the right that ANYONE (including the president) has to listen. Again the subject in the video was not denied his freedom of speech or to peacefully assemble. He was not allowed to do it in an area close to where the president was currently at.

When our country was founded and our founding fathers were still alive they told the Supreme Court that the BoR and the Constitution were NOT to be interpreted, that the founding fathers used CLEAR AND PLAIN English so that even a simple man could understand what their rights are. In other words, the Supreme Court violated our rights by saying our rights could be curbed.

Dan McCarthy is a dumbass. And so are any of you that think his "God given rights" were violated. UT is a public institution, but that doesn't mean that I can just go and start peeing anywhere I choose. Feedom of speech is what you can say, not where you can say it. Just ask TV and Radio. And for all of you Bush lovers, look at this in regards to feedom of speech; Google: Cindy Sheehan arrested at Bush ranch. They were told to move and they refused. Sounds so familiar.

Peaceful protesting is not unlawful, yet you equate peaceful protesters to law breaking; your analogy of peeing anywhere you choose is not valid as peeing in public is not lawful. It is disturbing to me that a protester of the wars can not hold a sign up for the president to see, but they have the right to protest and desecrate funeral services of our fallen soldiers.

@StagNews Yes I did. Anyway you are missing the point. I totally disagree with what he was trying to protesting about. However, I went to war for this country with the belief of defending its core beliefs. As in, The Constitution and the freedom of speech. Putting people in a corner simply because they don't agree with your policy is a step in the direction of dictatorship. I didn't agree with the young man, but I don't agree with Obama either.

Fred Phelps little family cult are the one's that protest at soldier's funerals, best know for protesting at Matthew Shepard's funeral and they are not allowed to come anywhere near the gravesite. His group has been arrested numerous times for pushing the limits. People at the funeral usually stand so the protesters can not be seen by the family menbers. Phelps is crazy and he is not a good example to follow.

@Aloanstar No one is allowed at the gravesite the family does not want. It is private property and mortuaries have the right to keep people out. Just like UT had the right to only let Obama supporters into the rally. This guy is a dirt bag! But just like protesters along a funeral precession, they have the right to hold a sign on public property. I wish we could use the S.S. to arrest panhandlers. The S.S. can designate the border as the protestor site. Kill 2 birds w/ 1 stone.

@802487710 Were you calling Fred Phelps a dirt bag? He is lower than that, but my point is that his is the one group I know who protest at funerals, but the distance away has increased. I don't agree that SS should push the protesters to the border. That's as extreme as Dan was. Didn't UT hand out passes to students on a first come first serve basis? I didn't see anywhere that they had to be supporters. I thought Bush was the only one to block people from his rallies...another dirty bag.

@Aloanstar They were allowed to go, however, they were not allowed to bring in protest signs. Not my point. Private property was my point, not a public sidewalk. I don't agree with all policies of Bush, however, he had protesters outside his house in Texas on many occasions. Protestors in San Diego were allowed across the street from the convention center in clear view of the center. I don't agree with any president pushing civil protestors out of sight simply for propaganda. Especially Obama

@802487710 The way I understand it was that perimeters were set up by the CIA and no one was to go beyond that. Bush should have had protesters outside his jail cell. His administration made up the whole lie that got us into this mess and along the way outed a undercover CIA agent....but no one knew who said what or did what...I'm sure. He is a war criminal and I wish he had a conscience so it would keep him awake at night. No normal person wants war or the lives lost at such a cost.

They did give the dude the chance to move without being arrested. It's not like he was walking by and they just ran up on him and arrested him. They tried to be civil and explain it to him. Do I think that they should have to right to tell you where you can walk with a sign? No. Do I think you should move if a cop tells you to move? Yes.

@Hanniballector50 - You have a good point that I didn't catch. I agree that the person recording & the person being recorded may not have planned this together. However I still believe the person being recorded was looking for a confrontation (instead simply moving across the street) and it still appears that the person doing the recording was supportive of this.

To the people saying the Secret Service "has the right" to do this, keep in mind that the gym where he was speaking was a football field away, that the president was in said gym for hours at this point, that Dan was not trying to force his way in, and that Dan did not make any violent move at any point.

Obama is without a doubt a socialist & a statist, but he is still the president and the Secret Service has the legal authority to shut down areas around the president & control access to him. The officer in the video was extremely patient with your behaviour. @steve77008. I respect your opinion, but if you listen to the audio, I am inclined to believe that the person recording the video just happened to see what was happening and started recording. In the description of the video post he apologizes for the poor quality of the microphone. Dan also gives the guy his email, I'm assuming to share the video. I think if it were a staged confrontation, it would have been better planned and shot. Just a thought, I could be wrong.

@Goumindong I would agree with that except for the fact that you see dozens of people walk by in the video. If they had closed the area off for the safety of the president and he was crossing a barrier, then sure go ahead and arrest him. They singled out this guy because he had a sign and they didn't like what it said.

@kuhlraum Keeping the walkway open does not necessarily involve keeping all people off of it at all times, but to keep people moving. Such that everyone can be cleared as the President comes through. I.E. if he was going to the area where the crowds were, or to another place, there would be no problem. But that was not the case
