There is a known problem with using the ~ key with Oblivion. If you use a remote control with Windows Media Centre you have to unplug the USB receiver from your computer before entering Oblivion. If this doesn't work, there maybe something else plugged into your computer which is interfering with Oblivion. Try unpluging each USB thing one at a time. Also, restart Oblivion each time.
