That is deceptive and misleading in my opinion. He also charges well over spot silver price for his rounds. It seems like a pyramid scam in that the folks at the top and middle of the operation make a lot of money. The folks on the lower end pay far more than their silver round is worth to have one.
Sir, I can add and I know that generic silver rounds are available for spot value widely in the market. The liberty dollar is selling for more than double that and there is no reasonable justification for that other than parting folks from their money. In my opinion, what he did in this video is not illegal. He presented the silver $10 liberty as "A new $10 silver piece.", as you said. This does not imply at all it is manufactured by the US Mint, nor does it imply that it is legal tender. All the merchant had to do was look at the currency they are accepting and notice that it says "negotiable".

Because chips are only used by that specific business/casino, they cannot be used or redeemed anywhere else, hence its not illegal.
Its like getting tickets for skeeball, putt-putt golf, etc - they can only redeemed at THAT business.
However if you try to "use/purchase" or redeem them at a different business, by law, that is illegal.
