I now have the practice of pulling over the moment a cop on the other side of the highway hits his lights, my speedy stop usually results in the officer thanking me for not making him chase me and has also resulted in everything from lesser ticket to no ticket at all, the latter having happened most often.
Rent some track time if you need to get your jollies @ high speed, that cop wasn't pulling him over for anything but high speed driving & he knew it.......

when the police officer lost sight of your friend your friend should not have said anything when he was pulled over. He could have said that wasn't him. The officer could not prove anything since they lost sight of the motorcycle. Your friend could have just pulled out from somewhere, the point is the officer couldn't prove anything. I don't understand the point of the video. The motorcycle was clearly speeding and the cop apparently pulled him over once he caught up to him. This video doesn't show anything. What's your complaint? Looks like you're trying to make something out of nothing.
If a vehicle comes up behind you running lights and sirens you pull over regardless. They may be after you or someone ahead of you or they may be responding to an accident you're about to drive into. This also applies if a big red truck comes up behind you running lights and sirens.

holy shit i went camping with my family last year1, and it was that beach, (Thorne Hill Broome) and Sycamore Canyon camping grounds was like half a mile behind there. It's all on PCH, Right at the beginning, at the right, they were passing the big sand hill that people always love to climb, including me.

I do not see how your friend is supposed to know that the officer has the lights on for him, regardless of if your friend was exceeding the speed limit. It looks like he was. In that position, it is easy to estimate that the cop does NOT realize how fast you are going...and so you keep going also, not knowing that the officer is going to turn around. Evading arrest has a serious consequence, more than the speeding ticket alone.What was the outcome?

We hear bike engine but no warning sirens when that cop was exceeding the speed limit as the law says. And I'll ask again. You see lights come on going the other direction do YOU stop? Your friend was definitely speeding. Obviously CHP got him on radar which get's opposite traffic speed. He took off on video, you can clearly see him book it once he see's the cop and more so when the cop lights him up. He was just trying to evade like always. Make sense?

First of all you should not be speeding, he deserves to be pulled over, cop probably saved his life. When the cop pulled up to your friend he was way out of your view for you to make any judgement, so you can't take anyone's side, cop or friend. Your friend may have continued on a distance AFTER the cop got up behind him, thus evading arrest. He can cry all he wants saying he "didn't know the cop was behind him" but as a motorist he has the responsibility to pay attention to his mirrors too!
This happened to a friend of mine.. He was wearing earphones has music on.. lead the FHP on a 10 minute chase before pulling off to a the side, not knowing he had been "running" for the past 10 minutes... Its quite a story when he tells it..
Watched it close enough to figure out that he was probably significantly exceeding the speed limit and actually speeding up as the officer was approaching in the opposite direction. 30+ seconds is nothing when you consider that the officer had to slow down, turn around, and then speed back up. I am not a cop, but I used to be a Motor Cycle Safety Foundation Instructor and I currently ride a CBR1000RR. If he was not breaking a law, he should have slowed down upon seeing the cherries.
@GadgetOFreak Even if he did, since we didnt see it we wont know, the cop still decided to do it from the the opposite bound and to pursue past the bend of after no longer having him in view. And maybe the charge would be on exceeding the speed limit, but that would only be pertaining to when the cop stops his properly, and the evading the law thing is complete bull. We are expected to be lax on the police but at situations like this it should be reciprocated.
You're supposed to pull to the shoulder and slow down and stop if necessary when you see a cop with the strobes on, no matter how wide the road is. Lesson learned.

It looks like the cop knew he wasn't going too catch your friend so he decided to make up the charges. The cop probably called it in right away and so much time went by until he caught up to him, he had to say he was evading.

I have to disagree with the whole mirrors thing because I was doing 100 in a 60 and when I'm going faster than 80 I don't have time to look at my mirrors. My eyes are in front. And I lucked out because a county sherrif probably realized this after possibly following me and passed me doing about 115-120 with no lights. Scared the shit outta me but I slowed down after that.

I'm not a cop but If I were in his shoes and saw a motorcyclist pass by going the opposite direction I would have just radio'd fellow officers up north to watch out for a fast rider heading north bound. In this video the chp apparently makes a U-turn and passes the group of riders in a matter of 40 seconds. By that time the solo rider heading north is probably long gone. So the CHP officer punches it, probably accelerating to a speed over 100mph just to nab the rider.

There's something called "fruits of a poisonous tree doctrine" means if the cops articulation on this situation states the initial motor vehicle code offense is eluding police according to the video that is not true. Wa the roadblock on the same road and how far down? If it was the same road, obviously he wasn't evading, anyone who's smart enough to evade a cop with that much of a lead would branch off that road.
Lock him up and take his bike away. He saw the officer with his lights on and he also never returned to the group (ie slowed down). He knew that the officer was probably going to try and stop him, or at least radio in that a bike is flying past him.

I've been pulled over on my bike too. The reason they don't turn on the siren is so that they can get close enough to get your plates before you realize they are behind you.
@alehax27 Agreed. There was a police cruiser that stayed in my blind spot for a while. I did not know until I almost did a wheelie and he pulled up beside me and looked at me with his terminator sunglasses on. Then he went behind me again and stayed there but luckily I did not get pulled over.
It happened to us Mark. There are cagers who would comstantly call cops and tell them that riders overspeed on certain canyons and that would send these cops on a witch hunt. So, we switched canyons alternately. It sucks buy canyons are cash cows for cops.
I would definitely give a copy of this video to your friend's attorney so he can prove he wasn't evading. As long as it took that cop to pass you there was no reason he should have assumed the cop was coming for him. If he kept going after the cop caught up then maybe he was evading but if he got to the roadblock first he clearly wasn't evading intentionally. Show this to his attorney and he may get off the hook for the evading if not the speeding. Good luck to your friend!
In retrospect your friend should've slowed down whenever there's a cop, in the opposing direction or not. Im glad he's ok and did not crash. That's the important thing here.

It is unlawful for any person to intentionally flee from anyone the person knows to be a law enforcement officer and the person:
(1) Knows the officer is attempting to arrest the person; or

when the police officer lost sight of your friend your friend should not have said anything when he was pulled over. He could have said that wasn't him. The officer could not prove anything since they lost sight of the motorcycle. Your friend could have just pulled out from somewhere, the point is the officer couldn't prove anything. I do not see how your friend is supposed to know that the officer has the lights on for him, regardless of if your friend was exceeding the speed limit. It looks like he was. In that position, it is easy to estimate that the cop does NOT realize how fast you are going...and so you keep going also, not knowing that the officer is going to turn around. First of all you should not be speeding, he deserves to be pulled over, cop probably saved his life. When the cop pulled up to your friend he was way out of your view for you to make any judgement, so you can't take anyone's side, cop or friend. Your friend may have continued on a distance AFTER the cop got up behind him, thus evading arrest. He can cry all he wants saying he "didn't know the cop was behind him" but as a motorist he has the responsibility to pay attention to his mirrors too!

Watched it close enough to figure out that he was probably significantly exceeding the speed limit and actually speeding up as the officer was approaching in the opposite direction. 30+ seconds is nothing when you consider that the officer had to slow down, turn around, and then speed back up. I am not a cop, but I used to be a Motor Cycle Safety Foundation Instructor and I currently ride a CBR1000RR. If he was not breaking a law, he should have slowed down upon seeing the cherries.

I'm not a cop but If I were in his shoes and saw a motorcyclist pass by going the opposite direction I would have just radio'd fellow officers up north to watch out for a fast rider heading north bound. In this video the chp apparently makes a U-turn and passes the group of riders in a matter of 40 seconds. By that time the solo rider heading north is probably long gone. So the CHP officer punches it, probably accelerating to a speed over 100mph just to nab the rider.

It's a shame you all should get him lawyer!! #1. There's something called "fruits of a poisonous tree doctrine" means if the cops articulation on this situation states the initial motor vehicle code offense is eluding police according to the video that is not true. Meaning any other charges there after must be thrown out! Than you sue the department than sue the officer civilly for false arrest, lost time at work and stress pay!!! Just my two sense!!

Wa the roadblock on the same road and how far down? If it was the same road, obviously he wasn't evading, anyone who's smart enough to evade a cop with that much of a lead would branch off that road.

Lock him up and take his bike away. He saw the officer with his lights on and he also never returned to the group (ie slowed down). He knew that the officer was probably going to try and stop him, or at least radio in that a bike is flying past him.

I've been pulled over on my bike too. The reason they don't turn on the siren is so that they can get close enough to get your plates before you realize they are behind you.

@alehax27 Agreed. There was a police cruiser that stayed in my blind spot for a while. I did not know until I almost did a wheelie and he pulled up beside me and looked at me with his terminator sunglasses on. Then he went behind me again and stayed there but luckily I did not get pulled over.

It happened to us Mark. There are cagers who would comstantly call cops and tell them that riders overspeed on certain canyons and that would send these cops on a witch hunt. So, we switched canyons alternately. It sucks buy canyons are cash cows for cops.

I would definitely give a copy of this video to your friend's attorney so he can prove he wasn't evading. As long as it took that cop to pass you there was no reason he should have assumed the cop was coming for him. If he kept going after the cop caught up then maybe he was evading but if he got to the roadblock first he clearly wasn't evading intentionally. Show this to his attorney and he may get off the hook for the evading if not the speeding. Good luck to your friend!

In retrospect your friend should've slowed down whenever there's a cop, in the opposing direction or not. Im glad he's ok and did not crash. That's the important thing here.

I'll be straight with you Mark....I don't agree with your opinions on law enforcement most of the time. But on this one, I agree with you. Evading by definition is:
It is unlawful for any person to intentionally flee from anyone the person knows to be a law enforcement officer and the person:
(1) Knows the officer is attempting to arrest the person; or
(2) Has been arrested.
# 1 is the key here. Off camera, did your bud see the attempt and continue? Bet that is what LEO says...Bummer :(

Based on what I saw on your vid, IMO, LEO got a bit excited. I mean the worst it coulda been at the start was maybe speeding. But I didn't even look like your Bud was going that fast when the cruiser passed in the other direction. I think your vid may help his case. I wish him luck.

@Shogun09R1 -- Worst is, there's another rider who got involved. They did set up the roadblock i believe. Then a rider passed by heading to the roadblock. That rider is thrown into jail too. In tagalog, nadamay. Thanks for the info and concern man. Let's wish him all the luck...
