@JeromeAHorne It's the corps fault, but also DCI's not not requiring these teams to secure copyright before learning their productions. They spend lots of time in design meetings choosing literature. DCI secures a mechanical license to distribute material. the key is to NOT CHOOSE THAT MUSIC if they cant secure a mechanical license for the DVD. There are literally millions of other songs to choose from. I'm plenty educated as I work in Hollywood as a production Engineer and freelance producer.

Not the Scouts' fault. They did everything they could, but their priority is live performance. The show wouldn't have been as good without ESoM, and that's not okay. Go buy the tour DVD when it comes out. DCI DVDs aren't everything.
@linkjoshua12 LOL. DCI Blu Rays aren't everything? Try a major part of DCI income and the best quality recording of corps possible. I marched DCI because I saw the VHS of the scouts in 1995. If that closer was blacked out I wouldn't have dug that show even 1/4 as much as I did since it was there. This is a trend that started recently. DCI has 40 years of history, and the last three years are the years with blackouts... Amirite? SO FIX IT DCI. DEMAND that corps choose accessible music.
As a Madison Scout, I just want to reassure you that our admin staff did EVERYTHING they could to secure synchronization rights. The copyright of Empire State of Mind is held by numerous parties, and unfortunately not all of them were willing to let us synchronize audio and video. So it's either watch the drill in silence or hear the music with a blank screen.

Regardless of how capitalized the word everything is in your response, the term everything should have also included "picking a song as an alternative to a chart that cannot be successfully licensed" as some kind of contingency. We all have backup charts in our back pockets... I'm just alarmed that this seems to be the status quo to allow these things to happen. I can't imagine the DCI office is pleased about their product containing dead air either..
@r0nej00 As another Madison Scout, I don't think you could find one single member of the 2011 Madison Scouts that would have wanted to change the closer based on the fact that it might be blacked out on the DVD.

There are innumerable other jams on the level of ESOM that could be played. The scouts have a rich history of some of the most epic closers... I hate to see even one of them blacked out for any reason.
Don't forget that crown and cavies got cut a bit too, but nowhere near as much as Madison.
@r0nej00 - did you notice anything weird about sounds coming from the left side of the field as compared to the right?? Most notable to me was the cavaliers drumline as they moved from the left side of the field to the right, and during Phantom's high brass vs. low brass features, the low brass sounds way different that the high brass. As in the high brass sounded a bit muffled compared to the low brass
@pizzaking50 all i know is that the giant ensemble sick our synth did at the bones in our performance is still on the DVD, so i'd assume they didn't edit too hard :))) There are notes around from DCI stating that they had to edit some samples out of Cavaliers show and another one. I'm fuzzy on details. There is plenty of editing involved, but the giant searing synth sound you hear during the ballad of the Crossmen show proves they didnt tamper too hard with non finalists haha!
@brown55061 I say blame the corps and blame DCI for not insisting the corps at least in finals can be filmed in their entirety. The corps has a duty to it's members to ensure that the literature chosen can be saved forever in the student's souvenir, the effective meaning of the DVDs no matter who wants to say otherwise. DCI has a duty to ensure that it brings the full value of the product to it's consumers in order to keep sales up and keep the public's faith in their product strong.
Yeah I see your side of it too. Just so happens they had to edit out one of the best liked programs and one of the most climactic points. Even in my highschool we had to pay copyright fees for sheet music so why a Div1 corps can't ensure this as well is beyond me. Very upsetting on all parties account!
@r0nej00 You're treating DCI like some corporate machine, however, and it is MUCH MORE than that. You wanna keep the public's faith in their music? Go see a show instead of buying some DVD, it is a world's difference. And there are always tour DVD's from the corps themselves, or documentation otherwise, so it's not that big of a deal.
@TheGWalka I was on tour teaching the crossmen for 5 weeks this summer. I've been to shows. I got to listen to the scouts play their closer a zillion times while I was working. I wanted to see it on my DVD. And I'm sure the members of that corps as well as all other finalists who bought their souvenir would like to see the corps shows in their entirety. DCI has the best master collection of all corps that appear at championships. The corps do not keep their videos forever, friend.

However, you are very right on the fact that they should have figured it out way before because it does ultimately affect the customer, like you said.

Before the season, they crafted an excellent show. Unfortunately rights to this song were simply inaccessible. I'll take 2.5 minutes of black on my dvd over having performed a sub-par production (with accessible rights) any day.
@davidwantland Show was great, but its selfish to think that the members of the production are the only ones to watch. what about future generations of scouts that will be watching this video and making their decision on where to march based on the content thereof? Scputs are known for epic closers. The people in the future will have no idea how great that closer was. If a tree falls in the forest and nobody hears it, does it make a sound?
