Wiretapping needs consent only if it is being taken place in location of "expected privacy." The 4th ammendment contains info on wiretapping and explains that public places or places viewable from the public are not places of "reasonable expected privacy."
So filming on the street, from your house (looking outside), or from your car is fine, as long as you dont interfere with what the officer(s) is doing.
Cop is still a person, he has rights to his privacy like anyone else. You need to get approval to tape and broadcast about a person's personal life. Whether you like m or not, most of them are there to protect you, and those you love. Most people only hate them cause they got done for speeding or something, and disagree. Grow up.

Yup, just checked and you are correct. Not sure how I got to reply to this specific video post however. I was watching another one of a guy taping a cop who asked him not too. He wasn't agressive or pulling guns etc, but he was simply trying to break up a public gathering which he deemned inappropriate.
But in this vid its a diff story. 16 years seems far fetched, and wrong indeed.

Read your wire tap laws, when your in public you can not get in trouble for video taping a cop, there is no privacy in public. Wiretap laws happen if you are in a private residence and you video tap someone with out letting them know it is happening.
Now if you have signs posted that your house is video monitored and it is posted on your house in front then yes you can video tap in your house without telling anyone. also Wiretap laws apply to Copper phone lines more.

I don't think the police should have the option to withhold consent while in the line of duty. Just so everyone is clear, a cop can lie, and record your information without your knowing, he can even lie saying that he isn't recording when he is, and all this is perfectly fine and legal. But you record a cop is a public area with a camera, and that is illegal. Police are suppose to work for the people, but once you tie their income to their tickets, corruption is going to follow.
Maybe we need to vote that all traffic tickets go to paying unemployment benefits.

I don't see the difference in using a security camera to catch a robber to filming a cop smashing someone's head in or acting unstable. Both are crimes. We finally have the technology to film police brutality and racial profiling for proof and now they want to throw us in jail for it. Aren't we being upright law abiding citizens if we catch cops breaking the law? That's us fighting against criminals am I wrong?

There is never any expectation of privacy in a public area. People can photograph or videotape you anywhere in public.
The police should never worry if they are being taped, because they are doing their jobs correctly. Taping what is happening is the only way to have a chance to protect yourself against a "professional witness" and capture exactly what really happened.

Departments routinely audio/video record their officers and suspects with "dash-cams" which have both secured convictions, and other times ended law enforcement careers of brutal cops.

Wire Taping laws like that are important I don't want creeps just video taping me everywhere, and I know they use it against peeping toms. That said with the number of violations from police I believe taping incidents is a good thing and this seems to be in a very public venue, etc.

I don't think the police should have the option to withhold consent while in the line of duty. There needs to be a level of transparency in the government lest it become a police state (which it slowly is). Particularly as they videotape me with voice as they see fit, whether or not I consent. This may set a precedent.

If the officer is arresting you then ya put the camera down if he requests it, something like put your hands behind your back. If I was a third party and just taping it, and he asked me to put it down or stop I would say, No thank you officer I choose not to.

I'm really just stating the obvious..but, I'm pretty sure that 8/10 pricks that join law enforcement aren't even aware, or don't give a flying fuck at a rolling doughnut that they are a public servant of the community...you know... to "protect and serve" not to "punish and enslave for our own fucking amusement."
But I do give credit to those 2 out 10 cops who aren't racist, or sexist, or psychopathic monsters and actually join to do a good and fair job.

It is not wiretapping to film someone in a public place.where you have no expectation of privacy. Wiretapping would be if you put a hidden camera in someones home and filmed them without permission. It's so hypocritical that the government films us in public everywhere we go but we can't film them. It should be the other way around. It should be illegal for the government to have cameras in public places and it should be and is legal for us to film the government in public places.

He was pulled over by an off duty policeman in an unmarked car, who was not in any uniform, cut the motorcycle off on an off ramp, pulled out his pistol pointed it at him, never said he was an officer, just demanded he get off the bike, when the patrol car came, he quickly put his gun away so the other officer, or other officers police camera would not see it. He was not arrested for wiretapping law until after he went home and posted it on youtube.

Johannes Mehserle, a cop that executed Oscar Grant at BART train station in Oakland, was found guilty of involuntary manslaughter. Not first-degree or second-degree murder. He'll spend less than four years behind bars. That's American justice for you.

The wiretapping laws are for private conversations, a public issuance of a ticket or during an arrest is not a private conversation. Recent cases have suggested that video taping cops has uncovered corruption and cover ups.

As I see it, it is the responsibility of any institution/group/individual with authority over the general public to justify itself via it's actions and application. If the police can't accept having their actions documented when on the job (especially when they're breaking the law), they don't deserve the authority they've been given.

The whole thing trying to pass it off under the wire tap law is ridiculous as well. A police officer is a public servant position and any actions they take are pretty much public especially if they're pulling someone over on the side of the road. Its hardly a private encounter. It looks as if the state is trying to protect its unruly cops.
