    However IMO, if you are on a school function then you are bound by school rules. If someone's kid goes on a school function and ends up missing it's the school's fault, so the reverse should also apply.

    1. You dismiss the "disturbance" qualification too easily. The banner could have blocked student's views, it could have offended religious students, and, most importantly, Frederick enlisted students in school to help him display the banner.

    2. Even if we toss aside the Tinker precedent application of "disturbance," you are forgetting the precedent of Hazlewood v. Kuhlmeier that states schools can censor almost any speech produced under their auspices. Field trips = school.

  • I agree that the banner may have been inappropriate, however the student was technically absent for that day so in the event of an absence, no member or staff member of the school has any jurisdiction over what they say. It's the parents decision. If they want to punish the kid, then they can do whatever the hell they want, but the school shouldn't have a say.

At least we can take solace in the fact that the decision was partially based on the claim that the banner failed to express any intelligible message (not a terribly convincing rationale, in my opinion). At least if the banner had said "Jesus wasn't God" or "Our School Sucks" or something he would have had a better chance of winning the case... maybe.

    And I thought we had our rights on public property. Free speech on public property, I would think, supercedes any absurd school rules. Kids should not be suspended or punished by schools for stuff done off-campus, except under very special circumstances.

I believe no action should have been taken against the student regardless of what the banner said as it was a right the architects of this country intended to be preserved, but as a lot of our rights have, it is starting to disappear. The Bill of Rights was not meant to be amended no matter make as it was part of the foundation of this country and in my mind no action by the government should be able to alter these principles.   • Most unfortunately, the ruling passed favoring with the school's decision, and against the students; while this clearly is an unfavorable outcome, in a twist of irony- the majority cited the "bong hits" segment of the banner as grounds for the decision of the majority. It very well may be a sad, sad day for 1st amendment advocates, if this is indicative of where our judiciary's leaning.

  • I agree with greenholic, When I was researching this case, religion never came up in the arguements. It was based on the advocation of illegal drug use during a school sanctioned event. By singling out Starr in this video, by saying he is a christian, and also with a pure partisan mind only paying attention to the Jesus part of the sign, seems to me that you made this video just to stir up another religious fiasco.
