And if a student commits a crime, well then, the federal court system will prosecute and punish that student accordingly. So there's no need to suspend him since his punishment by the legal system will be far worse. Of course, they could expel him for being a law-breaking student on campus gruonds if he did something like murder and came back to school 20 years later to get his diploma.

Schools can't say "Well, you can agree with and parrot the school policies, but we're gonna suspend you if you disagree." Where's the logic in that?! These idiots running the public school system just don't want their policies questioned. They want students to be robots and drink the Kool-Aid. That's all public school is: a gov't indoctrination center. Individuality isn't encouraged; conformity is.

If a student says "Drug testing is wrong", can the school suspend that kid for questioning their policies?? Where do you draw the line? What if the banner said "Drug testing sucks"? Could the school suspend the kid?
And I thought we had our rights on public property. Free speech on public property, I would think, supercedes any absurd school rules. Kids should not be suspended or punished by schools for stuff done off-campus, except under very special circumstances.

I am republican and Christian. I believe no action should have been taken against the student regardless of what the banner said as it was a right the architects of this country intended to be preserved, but as a lot of our rights have, it is starting to disappear. The Bill of Rights was not meant to be amended no matter make as it was part of the foundation of this country and in my mind no action by the government should be able to alter these principles. Also, Fox news sucks.

technically they're right about the "bong hits" part. It's promotion of drugs, which is against school policy. Th real trick here is that he was off campus. He can make a case for free speech iff he wasn't at school, however the school can make the case that the kid was representing the school. I'd have to know more about the details.

Most unfortunately, the ruling passed favoring with the school's decision, and against the students; while this clearly is an unfavorable outcome, in a twist of irony- the majority cited the "bong hits" segment of the banner as grounds for the decision of the majority. It very well may be a sad, sad day for 1st amendment advocates, if this is indicative of where our judiciary's leaning.

I agree with greenholic, When I was researching this case, religion never came up in the arguements. It was based on the advocation of illegal drug use during a school sanctioned event. Although I wouldn't want my child to hold up a banner with that message, clearly the principal had no right to suspend that young man. And it violates the first amendment. I also disagree with Fox's portrayal that it has "nothing to do with religion." It always has to do with religion.
