  • What you don't tell your viewers is that the TWC reopened your appeal after this, didn't they? This recording cleared up the confusion and I bet they let you have your appeal.

You then went on to write a bunch of letters accusing the TWC of deliberately tampering with your appeal. You got all worked up into a tizzy over a clerical accident. Take a chill pill; learn to listen to people and to read things carefully and you'll save yourself from dying early from useless anger and stress.

  • The fax receipt from the law library doesn't say where it was faxed to; unfortunately the fax from one department to another doesn't say the # it came from. That's probably why they dropped the ball.

The hearings officer who you spoke to so derisively is simply trying to establish that you faxed it to an actual TWC number on 1-28-09. Notice how he ended the call as soon as you stated that?

  • (cont...)

My guess is that your appeal, having been sent to the wrong department, was then forwarded by fax to the correct department on 2-9-10, which is why the 2nd date got put on there. This happens a lot; people don't read instructions and they send it wrong. Now, it's true that the Appeal Tribunal (right department) should have noticed when they received your appeal that it had been faxed to them from the Commission Appeals (wrong department) and that it was timely; they dropped the ball.

  • Ms. Black:

When filing your appeal on 1-28-2009, you faxed the appeal to 512-475-2044.

This is the fax number the 2nd level (Commission Appeals) of the appeal process, which was not where you really needed to send your first appeal. The hearings officer pointed that out to you in this recording.

  • Man I had to deal with these people the other day and all I can say is what a waste of time. I was homeless and that is why I had to quit my job and they did nothing for me.

  • I can tell you why the TWC totally blows... Because they're inept, and act officious to people like they did to Sara at 0:16- "and again, if you could just answer the question that I ask, and then later if there's something I haven't covered, you may add that..." You know why they act like this? To intimidate and distract claimants. The TWC should be ashamed of their woefully inadequate discovery process, they really let Texas employees down...

  • It wastes time when claimants provide unnecessary information. They are given an opportunity to provide additional testimony.

  • Yeah, you're right... The TWC only allows enough time for their idiotic schooling of claimants- only to then disregard most of the material evidence and rule in error because the hearings officer has zero intellect and too great of a workload to do the job. Don't kid yourself, vaguy78, the TWC does not work in the interest of protecting the Texas employee from unscrupulous employers... And you know this.

  • were you fired? if so, why?

  • Send your appeal in a way which provides a receipt or TWC will claim nonreceipt or change the date.

  • It appears that Texas is working as hard as possible to deny as many people, even eligible ones. My previous employer is not contesting but TWC has still denied me because I attend school, two days a week for an hour an a half. they say this makes me ineligible because I would not be able to work a full schedule although for the past two years I've worked full time and gone to school full time????? I in the process now of filing an appeal
