@clayto1332 Its very simple, change the law to read that every person that comes into contact with lawenforcement during the process of their duites you must be able to provide proof of citizenship. That cannot be a DL, SSN, state ID. Only one document prooves you are a US citizen and that is the birth certificate. So everyone start carryin your papers and check everyone. Now it is a legal law.

IE the police cannot pull a car over for speeding and check 2 of the 4 occupants for citizenship. If the law changes and makes the cop check everyone, bam now its a legal law. @ArtemesUSN Actually they can, and have done so for decades, demanding proof of ID of passengers in a traffic stop if there is a reasonable idea that a crime is being commited, such as speeding, drugs, ect. Just try to avoid that at a police traffic stop and see how quickly they put even a white boy in the poky.
Most of the times that an officer asks for ID of a passenger is if there is another crime going on. Ask any officer, if there is one crime going on, usually there is another too!

That would be none, he was detained because he was hispanic. A US Citizen was cuffed and taken in because he didnt have his birthcertificiate on him. @ArtemesUSN The problem with your arguement is that in most states, there is already laws on the books that require you to provide proof of identity should an officer have reasonable suspision of a crime. So you have a driver, with no drivers license, and barely (or doesnt) speak english(which is already required to become a citizen anway), and 2 other peop in car also cant speak english, its probably a high probability they are illegal, and therefore reasonable to ask for ID.
@jacobew2000 The problem with your rebuttal is that none of those documents proves citizenship. Even if the person has a DL does not mean they are here legally. What about children? The only document that proves you are a citizen is your birthcertificate, unless you legally moved to the US then you have other supporting documents.
@ArtemesUSN For years, officials have said that a DL is a proof of state citizenship. That is how they tax you, and how they arrest you if you break the law. Furthermore, most states require you to show your birth certificate, or a federal document showing proof of citizenship to get a DL. Now u got states like NM that are havens by not demanding proof of citizenship for a DL. So ultimately, its a breakdown in the system to prove citizenship to get official documents like a DL by states.
@ArtemesUSN Thats probably because your first DL required you to show one, and every state afterwards just assumes that you showed a birth certificate the first time around. When I was 15, and getting my first DL, I had to show my BC as one of the official documents needed to get my DL. I think that my Highschool ID was also used as a form of valid ID because they had also used my BC as proof of citizenship. Maybe you have been from states with really lax requirements too, and AZ isnt as lax.

@ArtemesUSN The other problem is that you have radicals who are wanting to give DL and other forms of ID to illegal's, thereby making it hard to ID who is breaking the law or not. Its way too easy to get a DL, SSN, and to swap them around when someone wants to evade lawenforcement. Personally, I want to adopt the same law as mexico has: 1st offense 2 years in jail, 2nd offense 10 years in jail. Now try to explain how that is racist when mexico does it too?

The driver is white has DL, ins etc, but two passengers, one is Japanese the other Hispanic. Now the police officer asks for proof of citizenship or legal status from the non-drivers. That is illegal. Change the law to read that all citizens must carry their birth certirficate and check everyone, now its legal.

I just dont get it. A cop stops you for Any reason and the first thing they ask for is your license and registration. The new law CLEARLY states that a valid drivers license is proof of citizenship so WHERES THE PROBLEM. And when this law is upheld and this Sheriff thinks he can get away with not enforcing it that could lead to charges against him for failing to execute the duties of his position.

@clayto1332 Its very simple, change the law to read that every person that comes into contact with lawenforcement during the process of their duites you must be able to provide proof of citizenship. That cannot be a DL, SSN, state ID. Only one document prooves you are a US citizen and that is the birth certificate. So everyone start carryin your papers and check everyone. Now it is a legal law.

IE the police cannot pull a car over for speeding and check 2 of the 4 occupants for citizenship. If the law changes and makes the cop check everyone, bam now its a legal law. @ArtemesUSN Actually they can, and have done so for decades, demanding proof of ID of passengers in a traffic stop if there is a reasonable idea that a crime is being commited, such as speeding, drugs, ect. Just try to avoid that at a police traffic stop and see how quickly they put even a white boy in the poky.
Most of the times that an officer asks for ID of a passenger is if there is another crime going on. Ask any officer, if there is one crime going on, usually there is another too!

@ArtemesUSN The problem with your arguement is that in most states, there is already laws on the books that require you to provide proof of identity should an officer have reasonable suspision of a crime. So you have a driver, with no drivers license, and barely (or doesnt) speak english(which is already required to become a citizen anway), and 2 other peop in car also cant speak english, its probably a high probability they are illegal, and therefore reasonable to ask for ID.

The only document that proves you are a citizen is your birthcertificate, unless you legally moved to the US then you have other supporting documents.

@ArtemesUSN For years, officials have said that a DL is a proof of state citizenship. That is how they tax you, and how they arrest you if you break the law. Furthermore, most states require you to show your birth certificate, or a federal document showing proof of citizenship to get a DL. Now u got states like NM that are havens by not demanding proof of citizenship for a DL. So ultimately, its a breakdown in the system to prove citizenship to get official documents like a DL by states.

@ArtemesUSN Thats probably because your first DL required you to show one, and every state afterwards just assumes that you showed a birth certificate the first time around. When I was 15, and getting my first DL, I had to show my BC as one of the official documents needed to get my DL. I think that my Highschool ID was also used as a form of valid ID because they had also used my BC as proof of citizenship. Maybe you have been from states with really lax requirements too, and AZ isnt as lax.

Its way too easy to get a DL, SSN, and to swap them around when someone wants to evade lawenforcement. Personally, I want to adopt the same law as mexico has: 1st offense 2 years in jail, 2nd offense 10 years in jail. Now try to explain how that is racist when mexico does it too?

cops use profilling all the time if a bank is held up and the cops see two groups of men leaving the vicinity one group are men in their 20s the other group are men in their 80s which group are the cops going to stop and question. this man should be fired.

What bogus arguments. Try driving late at night on a weekend, even the slightest infraction and they're going to pull you over. Why? Because they're looking for drunks. It's a form of profiling and right or wrong it's what the police do and I'll bet this sheriff has no problem with that. As an officer he cannot pick and choose which laws he'll enforce and which he'll ignore. That's not his job.

Well, the sheriff's incisive critique of the law notwithstanding, I believe he's misunderstood his role in the legal system. Quick refresher: legislators make the laws, judges interpret the laws, and peace officers ENFORCE the laws. That's all society is asking the sheriff to do. We neither want nor need his opinion on the need for the law.

I just dont get it. A cop stops you for Any reason and the first thing they ask for is your license and registration. The new law CLEARLY states that a valid drivers license is proof of citizenship so WHERES THE PROBLEM. And when this law is upheld and this Sheriff thinks he can get away with not enforcing it that could lead to charges against him for failing to execute the duties of his position.

1. Have a comprehensive immigration reform now and bring those immigrants who have contributed to this country out of the shadow
2. Enforce the law not by punishing good hard working people but employers who hire illegals
3. Have a work permit program available for people from other countries, so they can come and work here legally.
4. Secure our border with technology; you cant sustain 4,000 troops for too long.

Also, being familiar with law enforcement, I can guarantee, he's probably staying more true to his oath by refusing to support this law than by upholding it.
