If they didn't have a permit to play there, then the detainee was resisting a peace officer from resisting a lawful seizure/distress [s. 129(a) and (c) of the Criminal Code of Canada - not to mention the Highway and Traffic Act]. That's grounds to arrest. Also consider the fact that by having everyone honk horns at the same time, he's breaking the peace. What I don't think the officers have a right to do is to tell the onlookers to leave the area if they're not obstructing.

OK, fact of the matter is:entertaining passing motorists as they grind through construction(Bathurst is like that on a good day with no construction)passively & in no way a disturbance-vs a cop car BLOCKING TRAFFIC to make a point -although perhaps not in the best 'legal' situation, it's like"hey,bud,you have a mosquito on your crotch"-then kneeing him!

If they didn't have a permit to play there, then the detainee was resisting a peace officer from resisting a lawful seizure/distress [s. 129(a) and (c) of the Criminal Code of Canada - not to mention the Highway and Traffic Act]. That's grounds to arrest. Also consider the fact that by having everyone honk horns at the same time, he's breaking the peace. What I don't think the officers have a right to do is to tell the onlookers to leave the area if they're not obstructing.

Dude, they asked them nicely for quite some time. After repeated instructions and his blatant refusal to cooperate, they arrested him (and frankly probably let him go later that day). They're not going to stand around all day and be ignored, they have a job to do. If I ever decide to act like such a prick to the cops I hope they arrest me. In fact, I'd pay them to arrest me if I were ever so disrespectful.
