I think that if the guy did NOT ask the owner to do something about the hight of the mirror b4 going to the courts , he should get any money .... now on the other hand if he had asked the owner to lower it , and the owner didn't do so then yes pay the man !!!!!!
It's lifeless bums like these that need their asses kicked. People who just want more money for no reason, without even getting off their fat lazy asses to do anything about it. Bullshit
There needs to be a civil equivalent of entrapment, where people like this can't get away with their bs. If they refused to make the owner aware of the issue, then they should have no grounds to sue.
Whoever filed the suit gives handicapped people a bad name.
People can sue business owners for non-compliance of laws they don't take an oath to but citizens can't sue government for Constitutional non-compliance. Law that they the government take an oath to. Doesn't make any sense to me.
its not a frivolous lawsuit, if a mirro is 2 inches too high i might not see whats on the top of my head, there might be a blood sucking bat attack to it and i might got rabies from that. stupid restaurants
If you're out there looking for a lawsuit so you can get a quick buck, you're nothing more than a petty thief. Also, If you're a lawyer supporting this you should be tried with felons. Why do we have a problem with people expecting something for free? Because of people like this who don't want to make an honest living but would rather spend all their energy trying to find the least honest way to make a buck.
I understand from a personal stand point that it's difficult to understand why you're being sued, but from the facts you state in the video you were in fact in violation of the ADA laws.
Good luck with the case. I think you should make a point (in court) that these people kept coming back and therefore it a.) didn't bother them very much or b.) was a premeditated attempt to collect money in a lawsuit.
This is not in keeping with the spirit of the ADA. I would venture a guess that if they (the midget suing) have prior knowledge of the violation and fail to report that violation, that they too are responsible for the violation. Too see a law being broken and then not reporting it is also against the law. I would file a counter-suit.
So how much did he pay out? Did he just lower the mirror and pay legal fees? If so thenthis guy is a bitch. If not where's the fuckwad fucking up everything?
Tyranny. Call it what it is. The government is laying a claim over our property, our businesses, our labor, our income. It is a mafia, a group of parasitic individuals who fund their lifestyles by preying on the productive, who are too busy in 9-5 jobs to defend themselves or take the time to understand the underlying philosophical illegitimacy of these laws which only now victimize them.
Firstly, I totally agree that this lawsuit is just frivolous. The plaintiff continues to patron this establishment on his own accord. SOmeone needs to investigate this plaintiff's background....I bet you'll find other ridiculous cases. If I'm not mistaken, I believe Pres. Bush passed legislation that would prevent this nonsense, and would allow the defendant to counter sue. This is un-American in its purest form. I don't know if the plaintiff is black or white....don't just assume anything.

@TruthAxe Yes, I'll continue...to follow your halfass economic theories. In fact, I'll subscribe to your channel to get the cutting-edge Archie Bunker armcahir analysis..tell us more, about the Rweagonomics and how the rich create jobs. . And about how the man is an employer, and "pays taxes." You did see his tax return, right?
If you have never owned a business... you have no idea of the scams that get worked on you. Some of the worst are government agencies. Osha, Saif, Irs, Epa, State regs, city regs, county regs, stratospheric protection agency, crooked banks & corporations combine with scam artists and insane customers to put you over the edge... Who wants the American dream? Get a gov. job and join the Bolsheviks.
If the customers had wanted their problems addressed, they could have simply approached the owner the first time they noticed the mirror was too high for them and pointed to the ADA clause requiring the mirror to be at a lower height. They obviously didn't want their problems addressed - it's more profitable to take the owner to court.
This kind of frivolous lawsuit discredits everyone facing real abuses.
read a case few years ago about a evil handicap guy. He was eating around in quite few restaurants in SF area staged falls and then suing those restaurants because their bathrooms were "not friendly" to him. He had his lawyer sent out blackmailing letters. Some of the owners were scared and pay him to avoid going to court. But one Chinese Restaurant owner fought him and won. Not only the court throw his out but also restrained him from filing further same kind of lawsuit.
@gordonshum LOL. Guess the lawyer must be out of work and in pile of debt so he/she wants to do something so bad and will do anything to make money. Isn't the cripple is on disability paid by part of the taxpayer's money? (the welfare)
The restaurant was, in fact, doing the cripple a favor. If the cripple couldn't see themselves in the mirror, they couldn't see how stupid they looked.
are you kidding me? its a fucking mirror! are the people in to days world seriously this stupid? i think they make shoes that will make short people seem taller!
To Onejanedoe2003. I Am so very sorry that you or someone you know are handicapped, And you think every one else should kiss your or there ass
because of it. I am 6' 10" tall and I have to bend over to see into the mirrors for the handicapped.
So should I file a lawsuit to have them raised or have a special one put in for me and other tall people. I too think the restaurant owner should have been given notice to have the problem fixed, And a follow up inspection to make sure it was done.
I didnt read all the comments on here, but i never heard anything in the video that told me this was even a disabled person, and I can tell you coming from a family member of a disabled person, this was probably NOT a disabled person that made this complaint.
No one is saying he shouldn't have fixed the problem. It's just ridiculous that something as small as a mirror missing the mark by two inches requires a lawsuit, thousands of dollars, and tax payer time and money to fix. You can't tell me that the simpler, more correct thing to do would have been for the costumer to approach someone in management, tell them the mirror needs adjustment, and let them fix it. Going to directly to a lawyer was totally uneccesary.
My only problem with this is that had this of been an offended minority, this would have never have been made public. Alas, because it is a disabled person, well let's just spill the beans and make them feel intimidated. Disabled people deserves the same consideration that everyone else in our society does.
it's being publicized because it's a frivolous lawsuit. it defeats the purpose of the disabilities act, because a lawsuit like this could cost enough money to close the restaurant, and then no one, not even a disabled person could enjoy the restaurant. moreover, compliance with a building code should be enforced by the city, not by lawyers. this is part of a series of videos about abuse of lawsuits, so your "problem" doesn't really make sense.
There need to be restrictions on how lawsuits are applied. Unless there is a physical injury involved, a business owner should at least be given the chance to correct a mistake such as this before a costly lawsuit can be forwarded.
This comment has received too many negative votesshow
Restrictions? The owner was not in compliance with the Disability Act! All persons entering his etablishiment was not fairly treated equal. If you are not in a wheelchair, then you have no idea the problems that disabled people who are, goes through. Walk in their shoes then write about restrictions.
The function of a restaurant is not to provide bathrooms. That is a courtesy. The entitlement mentality is pathetic in any form. Me me me is all we hear. Cut the business owner a break. If you find a problem tell the manager, don't go to a lawyer.
@pabobfin Exactly, but the biggest point to make is that a business owner should have absolute control over the conditions of his store, and whether or not he even wants to have a bathroom, or mirrors. Govt is to have absolutely ZERO influence in how a private service provider does a favor for his fellow free citizens by making food and saving them time. The whole economy is people doing one another FAVORS. Govt needs to stay the fuck out of it. It is tyranny.
It's time to get rid of the American with Disabilities Act. All it accomplished were these sorts of bloodthirsty lawyers filing these frivolous lawsuits. Because of that, it's much more difficult for a disabled person these days to find employment, because employers are so worried about lawsuits.
It's in a business' best interests to service to the handicapped. They would do it with or without this ridiculous ADA.
yo! nobody is going to receive punitive damages for that. all that that business owner will be ordered to do is lower the mirror two inches. If he lowers the mirror before the case goes to court, the case will be mute and therefor it will be dismissed. this is manipulative bullshit and the makers of this video are counting on your ignorance. tort reform is about limiting peoples' ability to stop corporations from harming the public. what these people want is a nation without the rule of law.
What a scam. I'd counter sue for court costs if the plaintiff lost, or I'd counter sue for the money the asshole won for perpetrating a scam on his business.

You know what the good thing is?
There are no monetary damages that you can recover under the ADA.
All you can do is get someone to comply with ADA standards. That's it.
Without some tort suit attached to this, there's nothing that anyone can recover in monetary damages.
