  • @Myaucat You lose your "rights" when you are drinking and driving. If you give an officer a reason to suspect you are drunk, the law in Canada says that gives the officer the right to investigate further. If you refuse to take a breathalyzer, the officer then has the right to bring you to the police station to administer the test there. This video was taken near my hometown, and the officer was my neighbor. The kid was charged with drinking and driving, and I don't feel bad for him.

Officers are given powers under legislation (the Criminal Code, Highway Traffic acts, etc) to detain citizens they suspect of being involved in unlawful activities. If they weren't, they would have no way of enforcing the law.

    If you think this violates your rights under the Magna Carta (lol) or the Canadian Charter, you should try actually reading them.

  • It's not common law here. He gave his license and registration which he contracted to get. He did not give up all benefits. He gave the officer jurisdiction when he presented a license for commerce and implied that was him. Therefore right to travel does not apply. He's driving for commerce according to his own admission. He claimed the name. Drinking and driving? Heart isn't right. He's in dishonor and making too many claims.

I'm unfamiliar with metric vehicular speeds, but 25% over the speed limit still seems fucking ridiculous and enough that if I was a cop, I'd immediately haul your potentially murderous ass to jail.
