No, he doesn't have AIDS, he is HIV positive. AIDS is a condition caused by advanced and unchecked HIV infection. You can have HIV and be asymptomatic and you can't spread AIDS. HIV is the virus, AIDS is what happens when HIV takes over your body.

@angryantiracist correct... moreover... once HIV moves into AIDS... the person actually isn't dying of AIDS...they are now dying of a myriad of things... you could die of lymphoma cancer or taxoplasmosis...etc etc... so the immune system is now so SHOT that it leaves the body vulnerable for the end disease to take over...so technically you're right BUT you don't die of AIDS... you die of "insert name of disease here" and you're right.. Jack is a good friend and he's negative :)
