of course its a states issue no one disputes that its in the Constitution that states give out licenses such as drivers, marriage, etc. the debate is over what defines marriage, because the full faith and credit clause in the Constitution states that states must give acknowledge and honor other states public acts, records, and judicial proceedings. So the debate is over what defines marriage and if states are wrongfully giving marriage licences to two people.
