I saw this interview and was amazed! I honestly don't think the interviewer was up to the task intellectually to follow what was being said.

I was curious about "waterboarding and WWII" so I found a couple of descriptions to understand what they were talking about.

"The Japanese used a fairly common method in which the prisoner had a tube forced down the throat and water pumped in until the stomach ruptured."

"What they did in WWII was pour salt water directly in the mouth and nose, forcing the victim to swallow it in an upside down position, then force them to purge that same water by stepping on his stomach."

Detainees are captured, they have a bag put over their head, their roughed up, kicks and punches, their flown half way around the world, no one speaks their language, their stripped of their clothing and forced to stand on a box for days on end, their punched and kicked again, their constantly hearing very loud music, it is very cold, they won't let them sleep, then they start to waterboard them.

If it's been illegal for 50 years, it isn't "ex post facto" to prosecute people for doing in from 2001 to 2008. Torture didn't become illegal in 2009. We've prosecuted people for it (including waterboarding) for decades.

Whatever happened, you cannot charge someone with a crime after the fact unless you have definative proof that they KNEW it was a crime at the time. Wrong. By definition, a crime is always charged after the fact. You can't make something illegal after the fact and then charge someone with that crime. In this case, waterboarding has been illegal for decades, and we've prosecuted people for it. It's fairly clear-cut, and whether they KNEW it was a crime is irrelevant. If something is illegal it doesn't matter if the accused knows it or not, just that it was illegal.

And yes, our soldiers are hurt, because other countries know we torture.

Perhaps I didn't make myself clear about the prior knowledge issue. In order to bring charges against the White House/Bush, etc., it would require having positive testimony from someone who would say 'I was in the room with XY & Z, and we heard the President/VP/whoever acknowledge that they knew that the techniques discussed were clearly illegal waterboarding as defined by...and so on. That is why you are not going to see any indictment at that level.

I don't consider it a clear cut, foregone conclusion that these guys were tortured. When the reports are fully released, then we can make a judgement. From what has been leaked, I find it pretty hard to believe that one guy was 'waterboarded' 66 times in one day and lived to tell about it. Smacks of bad form to me.
