Hulk Hogan owns his intellectual property, buying it from Marvel Comics. There was a battle over the "Hulk Hogan" name being too close to "Incredible Hulk" which is why on a lot of old merch you will see Marvel trademark info. Hulk then in turn signed a licensing deal with WWE for 20 years giving them the right to use his intellectual property. So Vince has a right to use the property but Hulk owns it (which is why he still uses it in TNA).
