I dont know what video you all were watching, but #1 the officer was saying since the perp hit my vehicle and it already has damage let me take the lead so if he break checks me or when I pit him, it will not damage a second so car.#2 in Georgia if the perp has commited a felony, we can chase him until the wheels fall off unless advised by a supervisor or state patrol to back off. #3

The District Court thought the facts were not so "blatantly" clear. The Court of Appeals agreed. Notwithstanding your own view, don't you think reasonable minds could differ?
The officer's request, "Let me at him" speaks volumes. Harris just nicked his car. He was pissed. He should not have been allowed to take the lead. Most police departments forbid it. And all police departments forbid ramming a car off the road into trees at high speed. The officer made this boy a quadriplegic.
No pedestrians and a mostly deserted road. The police seem to be doing most of the reckless maneuvers.

If deadly force is necessary and reasonable to stop a fleeing suspect, who is continuing to pose a immediate and immanent threat to the safety of other motorists and police, the answer is stop the car any way you can. The trick to all this that you have to do it in such a way to protect the PUBLIC not the criminal. The rights of the citizen and society to safety come before the rights of the criminal. I would like to say this does have some overlap with Tenn. v Garner.
Its unfortunate but Harris got what he deserved. Scott wasn't even trained to do the PIT stop he requested, he only did his job to the best of his ability. There was clearly no violation of Harris's 4th amendment rights. And it is fundamentally different than Tenn. v. Garner. You can see how dangerous it was to other traffic.
