I also saw cops cross a two streets and grab a camera out of someones hands, or a cop come on a persons front porch and demand the camera. Most copwatch people want the tape without fear of confrontation, or losing the camera & tape. These "interfearing" people rarely are convicted of anything, set free, and the cop gets reprimanded

The answer is -- the camera holds no evidence - the website does! I said to hand the cop a card that gives them the address to the site. If they want they can copy it - If they want it taken down send a court order to the domain.

I think the problem now is that you know that the officer was right, and you are trying to make excuses for yourself. The officer clearly stated that the camera was being taken as "evidence". You do knot know what happened prior to the start of this video shown on Youtube.

The Cop has to have reasonable suspicion that the person TAKING the video is not cooperating, (remember you just handed him a card telling him where he can find the video) and you as an officer can articulate in court why you suspect that the very person that was just taking the footage may try and destroy it...

It is best to have a cellular camera running as a backup camera by a second party whose main job is to video tape you. Now with this second cellular camera setup a service on it like Qik com or something. That way as soon as you finish filming the camera automatically uploads the vid to the internet. Then they can take the camera all they want, but the video is already on the Internet

I have searched myself and and asked those who disagree to come up with any statute or legal decision that allows such a confiscation. To date, no one has been able to present independently verifiable proof.

The only way I know that it could be made wrong to film officers on the job out in the public is if someone somehow would splice in things the officer didn't really do. A good friend of mine who is a very honest and honorable officer (an old guy who really is protecting and serving) is that they are afraid of being caught wrong so they take the camera and PRAY nobody says anything to the chief/sheriff. Evidence is not secured in that manner. There are forms and methods for securing evidence from private parties and the media. Ever see cops round up the general public whom happen to be standing around watching a crime scene and take them in as "evidence" ?

The filmmaker appeared to be filming a scene of a crime and it is that officer's duty to secure evidence at or around the crime scene. That includes cameras viewing the scene. I would like to see the apology letter too.

I think the problem now is that you know that the officer was right, and you are trying to make excuses for yourself. The officer clearly stated that the camera was being taken as "evidence". You do knot know what happened prior to the start of this video shown on Youtube.

Also, I highly doubt the the person who posted this video posted the whole thing. If there was evidence on the video, he could be charged with interfering with a police investigation.

The Cop has to have reasonable suspicion that the person TAKING the video is not cooperating, (remember you just handed him a card telling him where he can find the video) and you as an officer can articulate in court why you suspect that the very person that was just taking the footage may try and destroy it...
Under the circumstances that I just laid out - the cop would be in deep shit.

It is best to have a cellular camera running as a backup camera by a second party whose main job is to video tape you. Now with this second cellular camera setup a service on it like Qik com or something. That way as soon as you finish filming the camera automatically uploads the vid to the internet. Then they can take the camera all they want, but the video is already on the Internet

I think you are wrong. I do not think an officer can confiscate a camera unless it was directly used in the commission of a crime. My investigations agree with my belief.
I have searched myself and and asked those who disagree to come up with any statute or legal decision that allows such a confiscation. To date, no one has been able to present independently verifiable proof.
You may disagree, but it doesn't really matter without proof.

Remember, we are talking about someone simply videotaping. We are not talking about videoing porn or upskirt. Nor are we talking about after the cameraman is arrested, or suspected federal terrorism.

The only way I know that it could be made wrong to film officers on the job out in the public is if someone somehow would splice in things the officer didn't really do. A good friend of mine who is a very honest and honorable officer (an old guy who really is protecting and serving) is that they are afraid of being caught wrong so they take the camera and PRAY nobody says anything to the chief/sheriff. OH no. Those days are gone.

If you are going to be doing what your are doing you should also get a cell phone that can broad cast a second vid to internet real time.. It is not very good quality video.
That way when the cop takes the camera and beats you to a pulp you have a record of what happened. Also proof for iad Some states have state licensing for cops that is where you should be complain of theft and abuse. If not them, then the fbi.

Evidence is not secured in that manner. There are forms and methods for securing evidence from private parties and the media. Ever see cops round up the general public whom happen to be standing around watching a crime scene and take them in as "evidence" ?
When law enforcement is scared of being filmed in public as public SERVENTS then they in fact must be commiting crimes. There is NO other explanation.

The filmmaker appeared to be filming a scene of a crime and it is that officer's duty to secure evidence at or around the crime scene. That includes cameras viewing the scene. I would like to see the apology letter too.
