  • i don't see how anybody can support mr wolfe's actions. instead of taking a reasonable approach (perhaps getting the officer's name, badge number, and going to the station and discussing this with the officer's superior, maybe even going over the law with them) he decided to resort to cursing, personal attacks, and verbal abuse. in no situation is this going to help you with cops. he didn't say "i disagree with the legitimacy of your authority", he said "fuckface".

  • The fact that his actions constitute a public disturbance is also legitimate if for no other reason than that they go far beyond what is accepted as the normal goings-on of society. Seamus and others like him make students look bad and discredit our other LEGITIMATE causes. Had he taken 10 minutes to examine the laws that he was boasting to know better than the police, he would realize his mistake, return to his office, and do the job that we the students pay him $30,000 a year to do.

  • What a joke. The police have a legal right to enter any property if given permission. The SFUO rents that space from the U of O but is not the legal owner of it. Also the arrest is for trespassing, which he would've had to do in order to enter the office, and the police have the right to pursue a violator of the law no matter where he goes to evade arrest. As far as Seamus goes, swearing constitutes "fighting language" which under certain circumstances (this one included) is grounds for arrest.

A family member of mine is a police officer and that is a common move to place someone under arrest when resisting, it is way less painful than seamus led on. I will be so glad when he is out of the SFUO, waste of our fees on this guy. By the way Mr. Wolfe, it is the owner who has the right to let police onto the property not the leaser... have fun fighting pointless fights but no longer in our SFUO..

    As for Seamus; he was badgering the officer and was warned not to curse at him. It's a disruption of a public space. An agent of the university would be granted the power to arrest such an individual anyway. He got his warning and ignored it. Then he was asked twice to comply before the officer applied minimal force. Textbook.

    (1) The relevant legal concept for the Trespass Act is "LEGAL OCCUPIER" not "owner". Your landlord cannot trespass your visiting friend from your rented apartment AND your friend has right of passage through the building lobby and into the elevator...! duh.

    (2) Swearing to a cop is not a bona fide public disturbance. Swearing is not illegal. You can use swearing to communicate your disagreement and frustration and anger to a cop. This was a false arrest.

    A lease does not constitute legal ownership of a property, it only says that they may use that space, but it remains the legal property of the University of Ottawa.

    As there is a tresspass warrant issued against Marc Kelly, banning him from uOttawa property, he is not allowed on uOttawa property.

    The Trespass to Property Act gives the OCCUPIER (not owner) authority to declare someone a trespasser, and if the student union was leasing this space, the police illegally entered their premises to arrest Kelly.

    And it is not a crime to swear in public in Canada. In R. v. Lohnes, the Supreme Court decided that an actual public disturbance that interfered with the space had to take place, and that cops cannot arrest someone just for cursing

  • I'm no expert but since he had a trespass to property ban on him, he broke the law as soon as he re-entered the building. He deserved to be arrested and I hope that he is punished to the full extent of the law. Also, even if they are the legal occupiers, they are not the owners and do not have the right to bar the police from the premises. I could be wrong but I don't think so. If I am, please let me know.
